i feel like you should just wait and see what happens. I am sure they will send the letter requesting more evidence, rather than canceling the check or smthing i duno i wld not do that... because they know ppl miss stuff out when gathering everything,,.. try calling the 1-800# and talking to a supervisor maybe not a regular representitve because they give you more misinformation ... from my own experience i called the other day ... i just felt like the girl was sitting on the computer and read everything off so try talking to somebody higher...

The problem with waiting is that you can wait 6 months and then they can deny the case WITHOUT an RFE and they DO that and they have done that more recently than in the past.

A few documents missing is OK, or one item, but if he has not even included evidence that he is a citizen, that they have met in person then there is no clear benefit that anyone is eligible for. It can just be denied as being SO lacking as to not even be worth considering.

Everyone tries to hurry them along as they wait with baited breath for their NOA2 and they have to find ways to cut the processing times. This is one way they are doing it.

PS: the girl WAS sitting at a computer, she is NOT at the service center and she IS reading off a computer.

well i dont know if i was in their place i would call and not wait :/ again speaking with a supervisor should be more helpful && not the regular representative

Our payment didn't clear due to putting on the incorrect bank details and I got a letter back two weeks later with all of my documentation with a note saying "Please re-send with correct payment details".. So if you sent a cheque, maybe cancel that cheque with your bank and they may send everything back because the initial administration fee has not been paid, so why would they continue with the administration of your petition?

He just sent the i-129f package without putting in any evidence documents in it!!!! I will be rejected or there will be another 1 year of waiting??? I cannot believe he made such ridiculous mistakes!

Jan,2008 we met each other for the first time
March 11,2010, I flew to Dallas to visit him. We started dating.
September, 2011, we made the most stupid mistake we could have, sending out packet I-129 application without putting in a single page of supporting document.
January 12,2012, we received our declined petition letter after 5 months :-(
January 20, 2012, I flew to Dallas to prepare the packet and sent out the fiance petition
January 23, 2012, we received our noa1
May 30,2012, we received our noa2
June 13,2012, Our case was forwarded to Montreal
July 4,2012, I received RFE
July 5, 2012, I sent out RFE
July 9,2012, Montreal received my RFE
July 16,2012, I sent out my Packet 3 (I did not call Montreal to confirm if they have sent out my Packet 3)
July 25,2012, I received my Packet 4 in email
September 4,2012 at 9:10 am, visa approved !!!
September 6,2012, Visa in hand
November 17,2012, POE in Chicago
February 09,2013, Wedding

March 16,2013, AOS package sent out

March 22,2013,NOA received.

If you are lucky. They will reject it and return it, check and all. Attach everything you need and send it back. This will be faster than an RFE.

If he included a check and signed the I-129f it may be accepted for processing and you would receive an RFE in 4-6 months, then he can send all the documents and you will get approved (if you meet all the qualifications) OR as we have seen here, they may wait 4-5 months and simply deny the case making you start all over. That will depend on the adjudicator.

You will know soon enough.

If it were me, and they accepted it and sent an NOA1, I would withdraw the petition and send a new one. You will lose the filing fee but you will absolutely avoid the possibility of having to start over in 4-6 months.

There is very little chance your documents could get matched up with the petition if you sent them later.

Please tell your fiance not to do ANYthing else until he reads and understands ALL the instructions.

We thought they might be rejected but then received the NOA1. We sent the rest of the documents with an explanation and a copy of the NOA1 hoping it would be connected.

4 1/2 mths later our petition was Denied !! - despite further efforts there is no recourse. Do not expect to get an RFE - it probably wont happen. You have to start all over again. Most people have busy lives, it is not until you go through this process that you realise how exact you have to be in everything you do/submit. Some people have been lucky and have received an RFE, but if you don't ... ? It is pointless blaming anyone - these things just happen sometimes. I can tell you it is heartbreaking.

Even if it means a new payment - it is worth starting again now before you lose any more time! Good luck.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

I'm so worried now.... How did I miss that information? only if I knew this website existed, everything would have been perfect... and the letters that we sent to them weren't clear either i think. I could have written a better letter than I did. :( but thanks for the info.... this is so stressful..

This is not as bad as you may think. You have to calm down so that you dont keep making mistakes and forgetting important information or directions. One step at a time. The directions are basic and easy to follow. Maybe you may need to hire a professional in this area so that everything runs smoothly for you.

Thank you for your input. This is happening more and more as people pressure USCIS more and more. They CAN and simply WILL reject cases rather than the complex and time consuming RFE procedure. If what you send is not enough to determine a benefit eligibility exists, they can simply deny the case. We can hash it over ad nauseum and here are the choices and there is nothing else to say, really...

1. The case gets rejected and sent back right away. Good news, start over and do it right this time, you got lucky.

2. The case gets accepted and the OP hopes for an RFE later. If they get the RFE, no big deal, if they don't, they start over. Good news...you save $340. Bad news...you could waste 4-6 months and still lose the $340.

3. The case gets accepted and you immediately send a withdrawl letter and send a new petition with a copy of the withdrawl letter. Good news...new petition done correctly (we can hope) and normal processing. Bad news...costs $340

I do not see canceling the check as an option.

This amounts to "I made a mistake and I am not willing to pay for it at the risk of postponing starting our lives together and maybe still having to pay for it later"

OR

"I made a mistake and it will cost me $340 but it is a small price to pay to insure we get this done as soon as possible, I will learn from my mistake and I am glad it is not the $455 other people had to pay"

Well all I can say is he was having a bad day or not thinking - some people just hate paperwork and would like it all to go away. Seriously .. the petition is not going to fly unless you are unbelievably lucky and they send an RFE (but I don't think so).

The wait for the NOA2 approval is a lot longer than it sounds. Every day gets more difficult and in my opinion, you will wish you had done something else earlier if you dont refile now. If you do, follow the Guides (top of this page) print it, and go through step by step. We didn't know about this site until we had our petition underway, but in our case it was just a mistake, a lack of attention on the day. Where I live, I would probably be able to walk up to a desk and ask somebody to help me fix the problem - but with USCIS, it doesn't work that way.

I think the guide says "check and triple check everything". That's how it has to be - and anything you're not sure of, just ask in this forum.

You are lucky that you haven't lost any significant time. So if it were me I would start again - it'll be worth a lot more than the $340 you may have lost. :yes:(F)
