OK - First off - cut him some slack. Consider this your first marital test before you have even gotten married. LOL.... All spouses/mates make mistakes from time to time. Be supportive of him in his time of error. A little heat maybe, but you dont have to flambee him here on the board. :blush:

Read this but dont get your hopes up. I have no basis for this, just sharing what I would do if I were in his shoes, with the week or two that I'd be waiting on the NOA-1 or Rejection or whatever notofication letter they are going to send......

A short term effort that might be worth a shot is to set up an INFOPASS appointment. Perhaps if your fiance appears pitiful enough, eats humble pie and acknowledges his error, has all the relevant papers neatly organized that he intended to include in the packet/thought he was supposed to submit later- PERHAPS the Infopass agent or Infopass agent's supervisor can provide direction on any possible means of submitting the necessary evidence without having to cause confusion and lose the money already paid. I do not know what criteria can trigger a "Duplicate Filing (without fee)" request mentioned below. Just be sure he is ready with everything handy. You never know who might take pity or offer to shuttle it up.

General Tips on Assembling Applications for Mailing

Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc.

Provide both the receipt notice number and the A-Number as an identifier, if they are available.

If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE (RFE), please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided.

If evidence is being submitted in support of a previously filed appeal or motion, a cover letter stating "BRIEF FOR APPEAL", etc., should be placed on top of the packet.

DUPLICATE FILINGS (without fee): Cases will be accepted as a duplicate filing only when USCIS has specifically requested that a duplicate be filed. In such a case be sure to submit the receipt number of original filing or any copies of notices received from USCIS on the first filing when submitting a duplicate petition or application.

cancel the check?!! wow...that's kinda bold...I am afraid I will be red flagged if I do that..

I agree with all the posts about canceling the check before its cashed, its not BOLD as you stated previously. There is nothing Illegal about a cancelled check its a service his bank offers and the government will just see this as the funds werent available at the time they got the application. Just chill out relax and cut your Fiance a break because honestly your being a bit hostile and overly panicked.

Our payment didn't clear due to putting on the incorrect bank details and I got a letter back two weeks later with all of my documentation with a note saying "Please re-send with correct payment details".. So if you sent a cheque, maybe cancel that cheque with your bank and they may send everything back because the initial administration fee has not been paid, so why would they continue with the administration of your petition?

IR-1 Timeline (DCF London)

15th Feb 2011 - Filed I-130 in London.

6th Apr 2011 - Sent letter requesting expedition of visa.

11th Apr 2011 - Received email approving request.

12th May 2011 - I-130 approved.

2nd June 2011 - Received case number via email. Booked medical.

3rd June 2011 - Sent forms DS-230, DS-2001 & cover letter today.

8th June 2011 - Medical Exam (£273.00 for medical & MMR/Tetanus injection)

11th July 2011 - Visa interview at 8am.

14th July 2011 - Visa in hand.

23rd July 2011 - Uniting my family today in San Antonio <3

11th Aug 2011 - Received 10yr Green Card in the mail

22nd Aug 2011 - Received SSN

the package was done in a rush and I think i should have been more attentive about it and explained everything to him other than let him do it by himself and then mailed it ASAP!!! I am blaming myself for being a slack during the package prep...thought he could handle the case but... :blush:

This is why i used fiancee visa service attorney. 100% money back guarantee is any RFE (request for evidence). Only one person checking the package is playing with fire. My bank dosent have my address on the check. So the attorney wrote it on there for me, since he said they will send it back without. I did pay 300.00 for his services, but he prepared my side and her side of everything. I rather pay more then make mistake and cause a headache, since this whole visa process is long enough as it is.

I would wait to see what happens. If you have sent just the forms and no proof, my bet would be they would return it to you because it doesn't meet the minimum requirements, and it's obvious that it doesn't. :)

If your packet is not immediately returned to you, you'll get NOA1 and eventually get an RFE when they're ready to review it. An RFE is not the end of the world. It delays things a few weeks, but if you have your proof ready to send out, then it's not like you're taking more than a couple of minutes to return the RFE request, the docs they need, and fed ex it out.

It will all be fine. Don't panic.

I personally would not withdraw and start over because I wouldn't be able to afford two fees. That's just me. :)

Try not to panic, just make sure that however this plays out, you both are EXTREMELY careful to read everything, double or even triple check all your documents, and be as thorough as possible. If you do everything perfectly, you can have the process finished in under a year... but as you're finding out, mistakes cause delays, and they can be incredibly lengthy.
