No you're not screwed. Canceling and refiling seem like a good idea to me, if they don't reject it immediately instead of send a NOA1. If you cancel, I suspect you may need to have the new I-129F indicate that a previous petition was filed, although I'm not sure if it matters because it was canceled before being approved... something to think about and ask if it isn't obvious (sorry I'm not going back and reading the form right now to see the exact reading of the questions about previous petitions).

If the check hasn't been cashed yet, you can cancel it and the petition will be rejected. Then you can start over without losing a filing fee but you have to act fast!

If you cancel, I suspect you may need to have the new I-129F indicate that a previous petition was filed, although I'm not sure if it matters because it was canceled before being approved... something to think about and ask if it isn't obvious (sorry I'm not going back and reading the form right now to see the exact reading of the questions about previous petitions).

Its previous APPROVED petitions, so you are fine, just make sure its cancelled or rejected before filing the new one.

cancel the check?!! wow...that's kinda bold...I am afraid I will be red flagged if I do that...He said he believe the government would give us a chance to fix it up by sending us the notice for the missing documents...but it seems like not the case to some people...so I don't know... :crying:

He just sent the i-129f package without putting in any evidence documents in it!!!! I will be rejected or there will be another 1 year of waiting??? I cannot believe he made such ridiculous mistakes!

I understand you are a bit frantic right now, but can you clarify what you meant by "evidence documents" so we can better assess the situation? Are you saying he literally mailed the three paged 129F petition and a check with NOTHING ELSE?

I am so sorry for your situtation and I am afraid I don't have much experience so I also don't have a lot of advice to give. I would honestly go talk to a lawyer that specializes in K1 visas. Check out the fees and see what they can do to help you in this situation.

When we first started the process I felt so overwhelmed with the paperwork and I felt like they were very sneaky on what they want you include and it was all very confusing for my fiance and I. We also knew that any wrong move we made could cost us months more of being apart. We chose to get a K1 lawyer and all of our worries were put aside. I am a school teacher and he is working a temp job so it is not like we have a lot of money; we just knew the cost was worth not being apart longer and feeling at ease about the whole process. We provided the information and he filed all of the paperwork very neatly and we were approved and received our NOA2 right on schedule with no RFEs. He will also be helping us with all the packets that my fiance has to file and preparing him for his interview at the embassy. I know a lot of people say that you can do the papers yourself, which you can, but I honestly felt like I couldn't and I was so afraid of making a mistake that I felt this was the best choice for my fiance and I. I hope this information helps you in some way.

PS Originally we were planning on just filing the I29F with nothing else. We had NO IDEA that you needed anything else!!! Thank God for our lawyer who is taking wonderful care of us.

As others have said, cancel the check. If the check can't be cashed, your application will be rejected and sent back to you. Then start over with all necessary documents.

That's the best result since you won't have to wait 4 to 6 months for a possible rejection and/or lose your filing fee.

On another note, what concerns me is that your fiance seems pretty nonchalant about the whole thing. But maybe it's just because he's unaware of the possible consequences. :unsure:

As others have said, cancel the check. If the check can't be cashed, your application will be rejected and sent back to you. Then start over with all necessary documents.

That's the best result since you won't have to wait 4 to 6 months for a possible rejection and/or lose your filing fee.

On another note, what is a huge red flag to me is that your fiance seems pretty nonchalant about the whole thing. :unsure:

Thanks, Harshness sometimes is not a bad thing. Guess it is not a big deal to him, that's why he was being so careless about something that is so important. I cannot image there would be another guy who had the real intention of marry another girl from other country would make such a outrageous mistake :(

I suppose it depends on what kind of person your fiance is as well. From reading on VJ, I've seen some couples where the beneficiary does most of the legwork on the forms and application and the petitioner simply signs, dates and sends out things. In most of these cases, the USC (usually the guy) hates paperwork and is not detail oriented at all. Could it be your fiance just falls into this category? :whistle:

Regardless, I would be livid and extremely upset too had my husband been so careless!

Right now though, both of you need to figure out what you want to do about the I-129f you have sent. Whether to cancel the check or to wait and hope for the best. If you decide to cancel the check, you'll have to do it ASAP.

Edited to add: The other thing to consider is that since your petition is so obviously lacking in paperwork, there is quite a high chance they will reject it immediately.

OK - First off - cut him some slack. Consider this your first marital test before you have even gotten married. LOL.... All spouses/mates make mistakes from time to time. Be supportive of him in his time of error. A little heat maybe, but you dont have to flambee him here on the board. :blush:

Read this but dont get your hopes up. I have no basis for this, just sharing what I would do if I were in his shoes, with the week or two that I'd be waiting on the NOA-1 or Rejection or whatever notofication letter they are going to send......

A short term effort that might be worth a shot is to set up an INFOPASS appointment. Perhaps if your fiance appears pitiful enough, eats humble pie and acknowledges his error, has all the relevant papers neatly organized that he intended to include in the packet/thought he was supposed to submit later- PERHAPS the Infopass agent or Infopass agent's supervisor can provide direction on any possible means of submitting the necessary evidence without having to cause confusion and lose the money already paid. I do not know what criteria can trigger a "Duplicate Filing (without fee)" request mentioned below. Just be sure he is ready with everything handy. You never know who might take pity or offer to shuttle it up.

General Tips on Assembling Applications for Mailing

Mark both the envelope and the cover letter as to the nature of the submission. Example: ORIGINAL SUBMISSION - BRIEF FOR AN APPEAL - RESPONSE TO REQUEST FOR ADDITIONAL INFORMATION - etc.

Provide both the receipt notice number and the A-Number as an identifier, if they are available.

If the packet is being resubmitted in response to a REQUEST FOR ADDITIONAL EVIDENCE (RFE), please place the notice requesting the additional evidence/information on the top of the packet. Also, please use the special mailing envelope provided.

If evidence is being submitted in support of a previously filed appeal or motion, a cover letter stating "BRIEF FOR APPEAL", etc., should be placed on top of the packet.

DUPLICATE FILINGS (without fee): Cases will be accepted as a duplicate filing only when USCIS has specifically requested that a duplicate be filed. In such a case be sure to submit the receipt number of original filing or any copies of notices received from USCIS on the first filing when submitting a duplicate petition or application.
