He just sent the i-129f package without putting in any evidence documents in it!!!! I will be rejected or there will be another 1 year of waiting??? I cannot believe he made such ridiculous mistakes!

I don't think you can send anything in, but you'll definitely get a chance when you get an RFE (request for evidence).

Even without fishing through lots of Internet to get the information, the instructions the government alone provides for the I-129F are pretty clear. Such reading comprehension issues would concern me.

I would expect you'll get an RFE saying what is missing, in which case he'll have one more chance to get it right. That could be 5 months though before he sees the RFE, unless they happen to send it early because his package was woefully inadequate.... I have no idea if he might get the RFE early but I doubt it.

If you are lucky. They will reject it and return it, check and all. Attach everything you need and send it back. This will be faster than an RFE.

If he included a check and signed the I-129f it may be accepted for processing and you would receive an RFE in 4-6 months, then he can send all the documents and you will get approved (if you meet all the qualifications) OR as we have seen here, they may wait 4-5 months and simply deny the case making you start all over. That will depend on the adjudicator.

You will know soon enough.

If it were me, and they accepted it and sent an NOA1, I would withdraw the petition and send a new one. You will lose the filing fee but you will absolutely avoid the possibility of having to start over in 4-6 months.

There is very little chance your documents could get matched up with the petition if you sent them later.

Please tell your fiance not to do ANYthing else until he reads and understands ALL the instructions.

omg.. i just read the the k1visa guide again.. and i forgot the proof of name change for both of us!!!!!!!!!!!! how did i miss that???? GREAT!!! we'll waste about 2 weeks for RFE..

Not necessarily so. It could sit there for 6 months and then be denied without an RFE for not having a clear eligibility for a benefit. It has happened in several cases here on VJ and then you have to start over, 6 months later.

There was someone in the March filers group that did the same thing and got rejected after 4 months without receiving RFE so it might be worth cancelling and staring over again, if they don't reject it straight off.

I don't think so, its going to go to Texas and the to a service center and before you get a chance they'll put it in the system. It would be nice if he also forgot to send the check or sign the I-129F so it gets rejected right away.

no. You can cancel it and withdraw it with a certified letter and then file a new one.

What would happen if the check didn't clear? Would that take care of the problem or just make it worse? (Just trying to think outside the box... perhaps horrible thinking outside the box, but its what I do.)

I'm so worried now.... How did I miss that information? only if I knew this website existed, everything would have been perfect... and the letters that we sent to them weren't clear either i think. I could have written a better letter than I did. but thanks for the info.... this is so stressful..
