Fiance Changing Jobs Prior to Interview

Timeline

My fiance got a new job and is starting a couple of days prior to my K1 Visa Interview. He has his tax transcripts and employer letter from his old job. It'll probably take him longer than a few days to get an employer letter from the new place he's working at. How do we prove he works and makes enough at this new place? He makes above the required amount at both places so that's not an issue. I guess it's just bad timing so any help and insight will be greatly appreciated.

If he has assets such as cash, property, and investments he should disclose these too. I do believe they take them into consideration when evaluating support ability. If his net worth without income is greater than the expected yearly income, I'm sure it would be considered sufficient along with a statement of being a new hire.

This is how I will approach the I-134 (since I took a leave of absence for 1 year to live overseas in my fiancee's country).

Not true!! If you don't have an income you can meet the requirement with assets showing 3 times the minimum amount, and I "think" it is 5 times the minimum amount for the I-864.

OP- is he a W2 employee or 1099?

If his net worth without income is greater than the expected yearly income, I'm sure it would be considered sufficient along with a statement of being a new hire.

He is a W2 both at his old job and the new one. It should be noted that the instant he leaves his old job, he will be starting his new job with no period of unemployment in between. Ie. He stops working at old job on a Wednesday then starts working the very next day for the new job. So technically he'll never not be working.

We just don't know how to handle the unfortunate timing of his job change and my K1 Interview. I can't move the interview at this point because I already booked my tickets and hotel room and everything.

I think you should be fine with a letter from the new employer.

If it will be a "few days" before the interview...and if his CURRENT job meets the requirements, simply provide proof for the current job and let it go at that. The I-134 is a "present tense£ document and there is NO requirement to provide up to date information that chnages after it is filled out. His PLACE of employment is not a "material fact"...in other words, IT DOES NOT MATTER. He makes enough money now, he will make enough money then.

Fill out the I-134 30 days ahead of time and be done. You will do a new I-864 when you adjust status and add the new job then. No one is waiting breathlessly for each change of employment status to be updated to the minute.

That is option 1

Option 2. Talk to his new employer now and have them prepare the letter ahead of time. A few days is not enough to have received a check stub.

I would personally go with option 1.

Option 3

List BOTH jobs and annual income. This is what I did. There is no limit to the sources of income, nor ANY obligation to list all sources nor any obligation to list all income. The obligation is to...

1. Not lie about material evidence

2. Show you can support your fiancee and meet their guidelines

I listed two sources of income and my total income, attached ONE years tax return, check stubs and employment AND bank letter. ALL of the numbers were different, ALL of the numbers exceeded the guidelines. There were no questions asked. People have various sources of income, people have non taxable income which is still income, people have reimbursements which show up as deposits in the bank but are NOT income...in other words there are lots of complications and NONE of them matter. He makes enough to support you. He is not even required to HAVE a job, he is required to have a means to support you.

If income exceeds the guidelines leave the asset information blank.
