My brother had filed I-130 for me in 2007, now my daughter wants to file I-130 for me in 2011, is there any problem for this duplication. If my brother does not cancel his petition for me and my daughter want to petition for me, then what will be the consequences of the double petitions for me

no problem, a person can have more than 1 petition at the same time, no need for canceling.

No issues.

I believe the one from your daughter will go a lot quicker than the one from your brother though.

Do not cancel the petition from the brother.

A beneficiary can have more than one petition filed for him/her.

As a US citizen, your daughter, can file for you as an Immediate Relative. This will take about 6-12 months unless you get put into administrative processing. Only you will get a visa. Derivative beneficiaries are not allowed when petitioning for an Immediate Relative. Your wife and unmarried children under age 21 will not be able to immigrate with you. Once you come to the US, you can file for your wife and unmarried children which would take about 3 years.

The petition by your brother will allow you to bring your wife and unmarried children under age 21 (age is determined when your PD becomes current and not when the I-130 was filed) will be able to immigrate with you. No need to file separately for your wife and unmarried children under 21.

Only cancel a petition when you have a green card.
