Hey Everyone,

I am currently 7 weeks pregnant (got pregnant while I was visiting my Fiance to apply for K-1...big woops lol)...I got my NOA1 July 14th. I was wondering if anyone has an idea of how long it takes for AOS because our baby is due end of April next year but I am worried I will not be able to have the baby in Texas because of insurance reasons etc or can I still be covered under my Fiance's insurance as long as we can prove we are married...any thoughts?? I know this isnt DIRECTLY K-1 but I am hoping that all the timelines work out etc..

Congratulations!

Have you fiance check with his HR dept. I was on my husbands insurance right away, before we even applied for AOS.

I would get yourself really up on what needs to be filed and when so that you can respond to things right away (medical, police certificates etc) to avoid delays in your process after you get your NOA2. If you want to have your child in the US, the clock is ticking! :)

Thanks a bunch!! I will have my fiance look into it at his job...I've heard that we only need our marriage certificate and I can be put under his insurance but still a lil worried.

Not wanting to scare you, but there is a chance you may not get the visa before the baby is born, or be too far along to fly by the time you get the visa. Hopefully it'll all go smoothly for you but you should plan for this eventuality.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, the K1. January is 6 months from your NOA1 date- possible, though maybe a little ambitious. But if there is any delays with getting police certs or any AP needed, or if London slows down again in giving out interview dates, or you get stuck in name checks after the interview, you might be delayed. Many airlines won't let you fly past the 8th month. You will probably make it, but there is a chance you will not.

Also find out if pre-existing conditions are covered if you can get on the insurance. Even on insurance, it isn't free. You might want to plan on giving birth in the UK where you will have family to help you out at first. It could easily be 3 months after your NOA2 before you get the visa. You will be cutting it so close even if it all went perfectly.

I hope for you that it all works out.

Making plans before you have your visa is risky. Although there are guidelines about processing times...nothing can be guaranteed. I had my K1 visa in hand 5months after applying. That is considered quick. Some people here got theirs more quickly than that and some peoples visa took much longer. USCIS advises 5months from applying to NOA2. After NOA2 there is more stuff to do including getting a medical, scheduling an appointment with your embassy and attending that appointment then waiting for them to send you your visa and passport back.

It might be ok. I don't want to scare you! It could be fine...but you should definitely have a back up plan.

Good call on the pre-existing condition thing...I hadn't thought of that. Definitely check that out! Your fiance's HR department should have all that info.

AOS takes about 4-6 months after filing which occurs after you are married, but AOS has nothing to do with insuarnce coverage. Marrying your fiance will make you eligible for his group insurance, BUT...

Have him check his insurance. They will likely NOT cover any pre-existing pregnancy. If the baby is born before you arrive the baby will not be eligible for a visa but WILL be eligible for a US passport/citizenship and will add to your family size for the affidavit of support.

They will not consider expediting a visa for pregnancy. Given the timing, the current processing times and the fact that a K-1 is valid for 6 months after issuance, I would say the best route is to plan on having the baby there, immediately file a CRBA with the US consulate and come to the USA when the baby has a US passport. Yes, it will delay your arrival. Or come earlier and be prepared to pay for it cash. Most hospitals give substantial discounts for cash payments. woops. LOL

One would not imagine that people who are making babies and getting married would be scared of such things. I am sure they will do what is necessary for them to do as responsible adults and parents.

When I was investigating insurance options in Virginia, the individual plans generally considered pregnancy a pre-existing condition but the Anthem group plan (through employer) did not. So long as you were insured before, which the NHS does count as :-) If you manage to move to the US before the birth then try to get your social security number asap, rather than waiting until you have your green card. The insurance company will probably want to know your SSN.

You may want to investigate the different birth options in your fiance's area: hospital, birth center, home. If you end up having to pay out of pocket a midwife will be cheaper.

It will all work out ok, one way or another. If you do end up in the UK to give birth there are positives to that: you will be with the same health professionals who provided your prenatal care.

The K-1 timelines are so unpredictable I got my NoA1 6 months ago and my interview is still almost a month away! Personally I think it just isn't worth the stress of trying to make definite plans before you have your visa in hand. Plus with the state of US Healthcare I think its preferable to have the baby in the UK, wait a few months and then travel over to the US. At least you won't end up with a big dent in your wallet if you can't get covered by insurance. Good luck to you!

If you marry your fiance and he has group health insurance through his employer, you can be covered under his policy. There is no pre existing for pregnancy under group health insurance in the USA. I worked in medical insurance for 22 years and they made pre existing for pregnancy illegal years ago. The baby would also be covered.

don't know about the consulate in england, but some/most consulates will make you give birth to the kid in your country b4 they issue u a visa

& if u try to enter the usa pregnant under the VWP, u mite also be denied at poe if your belly shows 2 much or they know ur pregnant

Agree with everyone else that the marriage should make you eligible. I think they will probably need a SSN as well.

The other issue is pre-existing condition thing, and even without that you've got to worry about out-of-pocket costs and what not. I have to admit having a child here scares the ####### out of me. I really don't want to go into debt just to have a baby.

Another issue is you will need a chest x-ray during the medical for the K1. Some people don't like the idea of having an x-ray while pregnant. If you don't have the x-ray you'll need to have it done before you'll get the visa which means waiting until you've given birth.

Are you allowed to fly in the third trimester? I didn't think you were allowed to.. maybe that's old news.

I would personally give birth in the UK and then file for CRBA for the baby and THEN go over. It's a lot less scary. Plus, having family around you during this time would be good, and maybe you fiance can take time off work to be there as well. I would want my fiance/husband there during the birth so I understand the idea of giving birth in the US is what you probably want more, but OMG the cost scares me :(
