i did my background check using talentwise website

and turned out i have 2 misdemeanor case from la county.

1. petty theft merchant from library : misdemeanor -> dismissed

2. petty theft under $50 : misdemeanor -> infraction (pc 490.1) happened back in 2004.

i went to the court to get certified disposition

it only showed second one ( pc 490.1 ) and my speeding ticket

i even double checked with the clerk if she only sees infraction charge

she said only two case is shown under my name which is infraction and speeding ticket

i am so confused about library charge, honestly, i dont even remember this case,

definitely didnt get arrested for it. ( if i did, i would know)

all i can think of is that i misplaced/forgot to turn in library book or media that may resulted this charge?

my interview is next monday,

should i mention this library charge?

i read few thread if you state cases then you have to tell IO what happened,

i honestly do not know what had happened and how i got this charge.

i researched little bit, and got this,

"since this charge is not on court record you dont have to mention it"

is all dismissed case not shown on court record?

but how come this is shown on my background check????????

please help

Why not contact the library involved and ask them if they have any more details. The other thing is it could have been an error on their part and there never was any information sent to you. It could also have been a case of mistaken identity. I think you need to try and clear up what this is about just so you don't end up backing yourself into a corner for 'misrepresentation'.

You have never knowingly had any information about this particular charge and it certainly doesn't appear of concern. If necessary, print out the information that you do have, document the efforts you have taken to find out more information about this, and then present this to the interviewer and explain you have no idea what it is about, you don't recall anything about this and have not been able to find out any more information. That way, you are covered if they have uncovered that information as well instead of not mentioning it and finding out they also have reference to it.

It isn't something that will cause a problem with citizenship in and of itself, but it has the potential for tripping you up so make sure that doesn't happen.

Lying is knowingly telling something you know is incorrect. The way I understand your post, you did not lie. If you want to cover all corners, just bring this library thing up at the time the I.O. goes over everything on your application. It really is a non issue for naturalization purposes, so just get it on record for piece of mind.

Thank you Kathryn41 and JustBob for honest advice.

i will definitely bring it up during my interview.

i hope this doesnt cause big of troubles by not putting it down on N-400.

( at the time of filing, i wasnt aware of this charge)

actually, i didnt put my speeding charge either. :(

(recently, found out from this site- traffic ticket is considered as citation so should have included on N-400)

Is your library really an issue? Couple of years ago, checked out a DVD, put in in my player, wouldn't read, but it revved up and the disk fell apart. Took it back, said I had to buy a new one, found a used one in perfect condition, a hell of a lot better than the one I checked out. They said no, has to be a new one, that cost me 37 bucks. So who is screwing who? No longer check out any media from my library, even though I am paying a bundle of taxes for that service.

Now if I didn't pay that 37 bucks, certainly wouldn't have sent the police to my home, would just be banned from using it until I did. Did go back a month later and found the DVD, was all scratched up, took it to the manager and asked why weren't they charging the loaners on this? Said it wasn't broken and still usable.

So help me, anything with anything dealing with the government, completely had it. Now those misdemeanor charges, that is what I would really be concerned about with the USCIS. This latest bit about proof paying traffic violation fines is ridiculous, if you don't, then the police come over, take your drivers' license and license plates until you do.

With Homeland Security, more than doubled the size of our police department with unmarked vehicles. When pulling up to a stop sign, make sure you park there for several minutes, or they will ticket you for a rolling stop. And 25 means 25, we have plenty of steep hills in town, they is where they hide, law is like a plate of glass, if your vehicle creeps up to 26, you broke that glass.

But if you have vandals come to your home, they run the other way. So much for Homeland Security.
