Yesterday we received the RFE letter we were waiting for. The RFE was in regard to the form I-864 Affidavit of Support. The letter said that the income did not meet 125% of the federal poverty line. My husband is the sponsor and his income for this year is definitely well beyond the poverty line. He's self-employed and his previous tax returns show less than 125%. Our assumption was that they base the affidavit off of this year's Total Household Income (question 24.c on form I-864).

We already included my husband's pay stubs for this year. We have scheduled an infopass appointment for next Monday. Hoping that they can provide any answer. I was wondering if anyone here had a similar experience to ours. I'm thinking more and more it may be best to look for a joint sponsorship. Any thoughts?

The income tax requirement is based on the previous year(s)and not 2011 since filing is done in Jan-april .Your best option is get a joint sponsorship and make sure that the joint sponser meets the poverty line .Good luck .

The office was running about 1.5 hours behind schedule so there was lots of waiting around, but our IO was very nice and relaxed. The interview probably lasted about 20 mins, with some of that time spent copying documents. Very low pressure and she asked basic questions like where did we meet, when did he propose, have we met each other's parents, etc. Then went through the yes/no questions of the I-485, and subsequently told us she was going to go ahead and approve the application. Got a letter form from her saying that it had been approved and to expect the green card in 3-4 weeks. Yay!

I have my AOS interview in January. My passport is expired - will this be a problem? I have read that you get an i551 stamp on either the passport or I94, but that they sometimes don't stamp expired documents. Will this even be a problem if I am adjusting through marriage? Thanks!

Im not sure whats gonna happen with expired passport, but i remember the first thing my lawyer asked me when we hired her she asked if my passport is not expired. I guess it might be an issue but i really dont know. Im pretty sure some knowledgeable member here will jump onto this and will help you! :) I also have my interview on January! Goodluck to us!

I do not think this is necessarily a problem, unless you are planning on traveling outside of the United States in the future. They wouldn't stamp expired documents, there isn't a point since you can't use that expired passport to travel anymore so the stamp would be irrelevant. However, I do not think an expired passport means anything in terms of getting approved; as long as everything else in your case is in order I do not think it's an issue.

I just had my interview last week and was approved...I had a valid passport and she did not stamp it. She did take the I94 and gave me the letter saying I was approved, but they certainly do not stamp every passport. In fact, the letter she gave me essentially said that they only stamp the passport if there is a pressing need to travel outside of the US before your physical green card arrives.

I called the USCIS number again today and told them that I'd been waiting more than 75 days for info on my EAD. They said my case has been assigned to someone and that I would have my EAD within 2 weeks. Here's hoping.

I wouldn't mind, but I think (although I'm not certain) that every part of my journey has been slower than the average. After you've been watching everyone else around you progress much quicker for ages it starts to grate on you a little.

Update on my Case: Last week we received an RFE explaining why my husband was exempt in his 2010 tax, we mailed the request earlier today. Before noon, we got a call from USCIS asking me a free day for my green card interview, so me and my husband told her over the phone that we want to have an interview as soon as possible, so we decided to make it happen on Friday noon Dec 23, 2011 at Kansas City. I think this is a good sign that my papers are moving. She took my husband email number coz she says she will email all the required documents that we need to bring and the complete address of Kansas USCIS office. I just hope everything will be fine..

I never get an update to my EAD and AP, i think they forgot about it already, they're just concern about the green card.

Is it possible to have an interview first before EAD an AP? just curious..

I dont think its a bad sign. To me its a good sign! You will be having your interview this week! :) im jealous! Please update your signature with ur complete timeline so we can see how your case is processing. :) update us about the email they will send you!

Hello VJ friends...

On sept 13, I filled for I-485 and EAD, I did a walk in fP on Oct 14. On the oct 15 my case touch online, after that i never hear anything back.

Then, last week, Dec 14, i called USCIS to ask why was taking so long, and the guy said that he was going to make a service request, and i should hear something within 15 days. That same day, i got a txt msg and email, saying that they had just sent me a letter requesting for evidences.

I got this letter yesterday, and this morning i sent it back to them with all the documents requested.

But i just got home, and i got another letter from them, and i almost cried thinking that was my interview date, but when i open the letter, was two pages. One dated on Dec 15, saying about my service request. And down in the letter there's a place that says:

The status of this service request is:

Our record indicate that we are awaiting your response to our request for additional eveidence on this case. Your case is currently in suspense or on hold until we receive your response. A copy of the additional evidence is included for your information. Please follow any instructions on that notice.

Ok, here is where i almost died: The request evidence copy that is attached to this letter, is dated on OCTOBER 18.

yesss....two months ago..and i NEVER got it!

Now, i just called them..and the stupid guy had read all of that things they had to read and transfered me to another customer representative, and this one said, that i cant ignore USCIS, and i have to re-send all the request for evidences again. Even if a sent one today (they should be getting it thursday)....

Oh men, I'm sooooooooooo mad! I had a huge expectations saying inside me, that i was going to be able to be with my family for Christmas, and then a couple of weeks ago,,,i was kind of accepting that this was way too impossible..and now seeing that because of their mistake, i cant be there...and i did not got not even my EAD, is sooo frustaded....dannnnn ....i'm so mad.

SO, what do i do? sent it again tomorrow? Write a letter with it?

Additional Update: We already received the email, It was the Form G-56 which is the so called "interview notice", and they needed some proofs too about our bona fide relationship, tax returns, valid ID's or government ID's, Passport and I-94, my husband proof of US citizenship, our current lease or rental agreement and Marriage Cert. I need to bring the original and Photocopy of all of this stuff. :whistle:
