Hi guys, i am about the submit the I-864 , but my income missed the 125% poverty line, and my husband just got laid off from his job(but a new job will start on JAN 2012). He is getting unemployment income. If his unemployment count, we just pass the line. I feel like my dad will get deny at his interview... i can not find any other joint sponser. Our last 3 years tax return, 2 of them miss the line too, 2010 passed the line. What should i do? Should i just cancle it and wait till we get better?

07/18/2011 NOA2

NVC stage

08/31/2011 Case number, emailed DS-3032

09/01/2011 Paid AOS fee $88.00

09/12/2011 Paid IV fee $404

I definitely wouldn't cancel it, you've paid too much and waited so long to re-do it all over again later. NVC will keep your case for up to a year with no communication. So, if you or your husband can find a job within the next few months, then you can just submit the AOS package then.

For now, pay the IV fee and mail off the IV package and let that be reviewed.

NVC either wants the recent year or the last 3 years. It's up to you. For our case, we submitted all 3 years of tax return transcripts.

As for your question on unemployment, I don't know. Sorry.

Don't forget, you've got a year to submit all documents to NVC.

Even then, you can submit new, current I-864 on interview day, as well.

When they look at qualifying income they want to see that the level of income is currently sufficient, and that there's a likelihood that it will continue to be sufficient for the foreseeable future. Unemployment benefits don't meet this requirement because they will expire long before the affidavit of support does. They'll usually disregard unemployment benefits as current income.
