Hi everyone i am sorry im asking this question again..i cant seem to find the answer

when i was brining my fiance here everything with affidavit of support went well my brothers 2009 taxes were fine.

-well now i feel like i might have an issue

My 2010 tax returns i made 9, 339, but thats only from March to December

-my brother filled jointly with his wife so on the FIRST page of his 2010 tax transcripts it says 19,400 smthing like that and on the SECOND PAGE on the tax transcripts the total income its about 34,000... and adjusted gross income 33,000 something which is on the 3rd page,,,,i am not sure which one they look at... i dont know if they look at his wife's income since he is the co-sponosor... maybe i should include her too??? i didnt have to when my fiance was overseas my brother was the only one

he also had a business side tax of around 16,000.. but his business is not like a firm ..hes just a independent contractor/ electrician....

my question is i dont know if my brother is making enough money...we live together.. he has a wife and kid... we have a house.. i just dont want something going wrong... i rlly dont get that 125% above poverty line... i am not dependent on my brother .. the only ppl on his taxes are his wife bcuz they file together and his kid... i have my own taxes.. so i guess the only person he wld list in his household wld me his kid, wife, and my fiance..???

if someone could pls explain to me how it works i wld appreciate it.. again im sorry for asking twice but i am starting to panic ... because i cant seem to find an answer

his income on line 22 is around 34,000 + but dnno if thats along with his wife ??? dnno i cant find his income .. they filled jointly....he also had a business side independent contractor.. dnno someone told me i cant include that because thats business :S its his business i dont know see why..that money goes to him its his income??? hes a electrician ..

It's extremely difficult to give advice for this form because there are so many scenarios.

I can tell you this: You will need his complete tax return, which will include W2s and 1099s. You can extrapolate from that how much income is his, and how much is his wife's. However, I really think that this calls for a separate I-864, NOT a I-864A, because your brother is head of household and needs to include his own wife and children in his household count, as well as your wife's as the immigrant. If you try to use I-864A because you live together, the household count will be all wrong.

You should fill out I-864 as the primary sponsor. Your brother should fill out I-864 as the co-sponsor, and his wife should file I-864A if you need to use her contribution to the income to make the threshold.

i am trying to get an answer i am not sure what to put for my brothers income on the form I-864A.... because he is married so him and his wife file jointly.... the amont on the Line 22 on his 2010 taxes shows an income of 34,000 i am not sure if i can put that since they are fillng together.. adjusted gross income on his taxes is 33,000 something somehing... the wages salary, tip shows 19,000 smthing i am not sure what that is....he also has a business tax 16,000 but as a independent contractor,, i am not sure if i can include that money... im starting to freak out .. ;( dnno if hes making enough monry.. it got my to the point to cry .. :(( i am soooo scared my income is only arund 9,500...

He makes plenty put the total income, get his tax records. Both of you together are fine. From other post, response from NVC - Please include the sponsor's individual income as indicated on the most recent tax return (if filing separately.) If you filed a joint return and you are not using your spouse's income, please verify your income from your W-2s for the appropriate year.

ok i just found out his wife was the one that made 19,000 something...their ADJUSTED GROSS INCOME IS 33,000 or 34,000 not sure so im guessing his income had to be more than hers??? i am so scared .. he is self employed well he has his business taxes as a independent contractor construction/electrician which is an income of 16,000... but some ppl r telling me i cant use his business taxes... i dont see y because that money goes to him..dnno .. its rlly stressing me out ;(

omg these "older members" just complain and have nothing better to do ...well if u know so much why dont u answer my question than???? ur done with ur visa so u have nothing to worry about.... ppl stress out if u rlly didnt know ...does it rlly matter how many posts i put on here??? i didnt put 100 i put like 2... ok? so relax a bit... im sorry not trying to be rude but ... when u do comment all u do is complain...

Yikes, criticizing the "older members" who have been here a long time and know what they're talking about is NOT the way to get help. They're just trying to explain how things work around here. I know how frustrating it can be waiting for someone to answer you....but someone will. If you feel you're post is getting lost at the bottom of a page...you can always post a bump to bring it up to the top again.

Wish I had some answers for you....but I'm sure someone will be able to help.

You were given good advice already. You just chose to pass it by. Do what Harpa Timsah told you. Forget having your brother fill out the I-864A. Have your brother fill out his own I-864. Have his wife fill out an I-864A to combine her income with his. They made $34,000 together. Their household count would be, your brother, his wife, their child, and your husband = 4. You need their W-2s and 1099s along with their tax transcripts. Those will show the individual incomes each of them had. He will list his income on the I-864, and his wife will list her income on the I-864A. On his I-864, there is a place to fill in the amount of her income from the I-864A and combine it with his on his I-864.

You are not their dependent, and will not be included in their household size. You will fill out your own I-864. Your household size will be you and your husband = 2. You did not make enough to cover the amount needed, but you are still the primary sponsor and need to fill this out anyway. That is why you will send in the other forms for your brother and his wife to be the co-sponsors. They have enough together to cover their family plus your husband.

No you don't. W2's, 1099s and schedules are only required for tax RETURNS. Transcripts (obtained from the IRS) have all that information listed on them.

Yes, THEY do because they seemed very confused as to who made what and how much. Having their W-2s and 1099s will make this CLEAR and evident to THEM. The transcripts have all the info on them, but they filed jointly and it did not help make the OP any less confused when looking at them about who made what. My post was aimed at trying to get them the info they need. If they used only the brother's income, they should include his W-2s and 1099s to show his individual income because he filed jointly.

"If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsor’s own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099."

Which is why I said:

You need their W-2s and 1099s along with their tax transcripts. Those will show the individual incomes each of them had.

Besides helping them understand better, it would not hurt anything if they included them, even if the wife files the I-864A and the brother isn't qualifying on his own.

.. im guessing i use some of my income and instead of me and my brother combining our income.. them two( him $ his wife) wld combine their income..and on top of all that my income... i was thinking to call the 1-800 # and speak with a level 2 Representative or maybe a supervisor .... as ive said my sister in law made 19,000 something.. i am not sure about my brother but their adjusted gross income is 34K.... and my brother also has another set of taxes from his business which is 15K or 16K not sure i have to look at it.. but some ppl r telling me he cant use his business income.. :S i mean hes the one making that money.. he is a independent contractor ( electrician)..its not like a firm or anything where 10 ppl work for him nothing like dat..do any of you know anything about that?

I suggest you hire a lawyer. Do-It-Yourself isn't for you, if you can't read the instructions which detail all of the answers to your questions, and especially if you are ungrateful for help.
