Hmmm...

So I have the same kind of deal going.

My father is the only joint sponsor and I sent joint filed IRS tax transcripts, his w-2's and his job letter. I did not send an i864A for my mother and I was approved at NVC without any RFE's . She has not worked all of last year and was on unemployment.

Should I be ok or should I have an I-864A ready with mom's signature just in case of this scnerio? They have all the documentation I believe they would need to break the income apart as I only claimed my Dad's income on his I-864. So all the numbers on the I-864 reflect his income only.

My husband had to submit another document to the embassy in ISlamabad... he went in person to the amex courier service used his pink token to submit the documents.. i think they asked him to fill out a paper for the embassy regarding the documents and then they received it within one day and at the end of the week they forwarded it to the CO in charge of our case. It took about 5 weeks total to get info that our review of the docs was complete and our case was fine but namechecks began so we sit in ap since then.

Hopefully that helps some in understanding what to do... good luck

Thanks...and are you guys attorneys ? How do you know this stuff and do you guys know this confidently?

Very few on this site are attornies and even if they were it likely for legal reasons  they wouldn't identify themselves as such.

In general, it is people who have been through the process. If you feel the need to consult attorney, I would not discourage you but as others have said, give them what they ask for and you most likely will be OK. The exact timing on receiving the visa is hard to say.

Did he go in for an interview and his visa was denied as well? 5 weeks after submitting documents seems like a long time for me atleast.

looks like all they are asking for is proof that your co-sponsor makes the amount that you claimed that's a pretty easy fix.

its not a denial but a request for the income proof

sara

thanks sara...hopefully you're right and it wont take much long.

He wasn't denied.. basically we're pending ap.... when ap completes then the visa is issued. It took a freind of mine about 3months for them to review her co sponsors info bcos they requested a different one than she had .. It just depends on the CO workload im sure....hang in there submit the new docs and just wait...im sure within a week or so the visa will be issued.

I think my situation is very specific....Let me tell you in detail what happened:

  • Wife went for the interview on Sept 9th
  • They checked the documents and saw that the i864A of my dad is missing. My mom was the sponsor and she files her taxes jointly with my dad.
  • My i864 was missing as well but they did not care. On the letter that they issued (attached to this thread), they stated that the joint sponsors income is "sufficient" ...does that mean that i dont have to submit my i864? I am wondering if i do, will it cause further delays?
  • They gave a blue form to my wife with 221(g) and returned i864 documents to her and asked her to send in the i864A of my dad
  • Also, they kept her passport. Why would they keep her passport if they knew that it may take quite a while?

Any input on this detailed report? lol

My biggest concern is the time it'll take after i submit the documents.

submit exactly what it is telling you to... don't overanalyze this they are being very specific as to what they want from you...

They gave a blue form to my wife with 221(g) and returned i864 documents to her and asked her to send in the i864A of my dad

Take these documents to the AMEX courier... the beneficiary should have a pink token which they NEED TO USE TO GET THESE DOCS SUBMITTED PROPERLY they need to be the one to take them there ... submit them to AMEX they wil have you sign a paper etc so that you will have a receipt saying you submitted... it takes 1 day for them to get it to the ISL embassy.. then it will take time to review... there is nothing you can do to make it go faster..

They kept my husbands passport gave him the pink token which he used to submit the extra docs.. then the end of the week we got notification they received them and forwarded to the CO... took about 5 weeks to finish the review and now we wait the AP out for security checks.

The longer you wait to submit what they are asking the longer it will take to get the review of the docs and the approval with visa.

But dont you think that they may have just missed out on MY i864? Maybe they didnt catch it the first time but if they review it again they may catch it....i mean the interview was the first time they reviewed i864 and they literally took few minutes to go over them...if i submit my i864 now im pretty sure it wont make much of a difference in review time but then again its just my guess. Lets say if i just submit my dads i864A...the only document they asked for and then later on they notice m,y i864 missing...then it will cause even more headache. Which is why im really confused what should i do?

That's up to you but if you had a co sponsor then your income wasn't enough anyway.. your i864 is the fact you are stil the main sponsor but it sounds like they want to verify the i864a of your father... but if you feel better about submitting the i864 of yours as well as the co sponsors thats up to you but it will take time to review... just get the docs together and send them to your wife and she needs to submit them to the AMEX courier with the pink token she was given. The sooner you do this the sooner they can review and issue the visa...

i think its better if I do just to be on the safe side. What if they see my i864 missing and they request it after taking some time to review my dads i864A...then it will take even longer..but ive had experiences in the past when they asked for a particular document and then later on told me that i am also missing some other document...its like they go over these things one by one.....but like you said its like flipping a coin....well i may have to flip a coin on this one. lol .

Heads I send my i864

Tails, i only send my dads i864A that they asked for.
