1-130 is ready but confused about middle name

Hello everyone...My husband and I got married last July here in Philippines. We filled out forms and everything needed for I-130

but not send it yet.He got confused about my middle name I used in marriage certificate is different from what I used in forms for

K-3. He told me that in America, their middle name will remain even if they got married. I explained to him that in Phils., what

we consider middle name is the maiden name of our mother. Once a woman got married, her maiden name will become her middle name.

He asked me if the VISA people knew about it. That is why am here hoping that anybody could help us. Does the UCSIS not question

about the change of middle name? Please help so that my husband could send the I-130 packet. Thank you...

Hi,

We had the same situation,different is we got married here in US.when we file for marriage certificate,.my middle name when when I was single is stil my name after we got married,& I was freaks out coz we don't do it there in pi,I called nso and philippine embassy about my middle name to be change,the pi embassy and they just advice me to use what is my name on marriage cert and they told me to come and see pi embassy to issue me a affidavit of identity so I hve to go there before I travel to pi,we tried to call the county where the place we applied for marriage license and f they can change my middle but they said they can't change it anymore,they told me to go to the court for change name,which is more complicated,anyways my thought is since you r going to.move here in us. U can just use ur middle name when u were single as ur middle now,after marriage.

On the G325a and the I130,,, We used the new married name,,, as you stated "her maiden name will become her middle name"...

Note: Seen previous post... She was a K1 and married in the USA... That is different then your situation...

Also, you might want to clarify the K3 filing comment. The K3 is filed after you file the I130.

The K3 visa application process is as follows.

1. File the I130 (CR1 visa)

2. Receive NOA #1 from the I130 application

3. File the I129F (following the K3 visa instructions) which includes submitting the I130 NOA #1.

DouglasFiel: Looks like you are going the CR1 route. Is there LingChe guide for K3 at NVS?

The K3 is all but obsolete these days... In our case the K3 was never sent to the NVC... It seems to have been terminated as the I130

reached the NVC first. This seems to be very common these days. Personally, I would do both again... As you just never know which

one will give you a better time-line.

BTW... Our CR1 visa was issued in August of 2009.

Thanks Doug,..I just wanted to make clear if there's no problem regarding change of middle name. What about your wife's

birth certificate when she brought it to the embassy and had interview?

How long did you wait to obtain IR1/CR1 visa? Since there are 2 options of bringing spouse to US but don't know which one

is better.

The birth certificate name would not match anyway,,, It has the birth name,,, Not the married name. They use the name as depicted on the

passport to generate the visa. We originally submitted her maiden name passport to the NVC... And, then gave St Lukes (Medical Exam) her

new passport with the married name. The US Consulate issued the visa and changed all of the paperwork to reflect the married name.

As far as visa issuance, Interviewed Monday and received the visa the same week,,, delivered to a hotel in Metro Manila.
