What is your timeline? When and how did you file the paperwork.

When did you get your EAD.

You obviously did not even go to the interview.

I adjusted status from F1 --> H1 --> 130/485.

Amazing news for all---

With our case, I had recently moved from Chicago to Texas for a job at the end of July. After much fighting for justice on our case, I was able to obtain the fax number and mailing address to the Chicago Office in which I received my denial notice from. I drafted a letter explaining the situation and sent it to the office along with my wife's birth certificate and copy of the denial letter. We faxed and mailed it and surprisingly today, I received a call from an immigration officer at the Chicago Office who said there was an error in the denial of our case and they re-instated it and will be transferring it to the Dallas office.

Come to find out I had an interview scheduled for August 1st which they say I failed to show for. However, I did not know about this due to moving. They were able to obtain the AR-11 showing my change of address that was dated in the middle of July and realized it was an error that we got denied. AMAZING NEWS!!!

NEVER MIND DON'T READ THE RESPONSE SEEMS YOU GOT IT FIGURED OUT NOW..... :) GOOD LUCK!

You need to make an infopass appointment at your earliest and you need to produce her birth certificate or passport, if possible I would go with both and if she can go with you take her too.

They dont have option to reopen the case but they might have some other option where either USCIS rep overlooked something or could be human error.

You can involve US senators office and see if they can be any help.

Reapplying is second option, I would try these things first and see what the outcome is.

That's excellent news! Hope it all works out for you here on in. Horrible thing for you to experience but so glad you've managed to get that sorted out!

After the denial notice I received, I went to an Attorney right away and she told me I had to file a new application, so we started on that procedure. Well, after the USCIS noted their error and automatically re-instated the case, my attorney notified me that my new application had been sent that morning. Therefore, I have my old application now pending and a new application that just was sent. My attorney said she would have to work to consolidate the cases, but is there a way we can cancel that application and get the money back?

Once the check has been cashed, your money is gone. No refund will be issued whatsoever.

Cancel the payment method. If the Lawyer used a check they can put a stop payment on it.
