I read in the other Canadian EI thread that it is best to wait until you actually enter the states to apply, reason being if you apply in canada and then move to the states it has to get sent to the interstate claims dept which could take longer?? Any truth to this?

That is very possible...because if you move to a different province it can take up to 2 weeks to transfer your file, so I'd assume it would probably be the same for interstate claims..

Removal of Conditions

Honestly if you're a K1 - 2 weeks is not going to matter - you're not getting your work authorization (EAD) until several months after you marry and apply for AOS. There have been some issues in the past when people don;t apply promptly.

For myself - my timeline was fairly fast. I finished work and moved a week later so I applied from within the US.

Why not?? If you have enough qualifying hours, why not! You have paid into it and doesnt cost anything to apply

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

Hi all,

I plan on quitting my job in August. I'm moving to sates in October. Should I apply for benefits ASAP when I quit my job and then let them know when I move? I understand my open claim will then be transferred to interstate claims and will most likely be held up due to me not having my EAD... So to get this straight, to collect my ei benefits when I'm in the states, I need to have my EAD?

Ye to be able to collect EI..one has to be legally able to work...and has a k1..u can't work until u get the EAD. Cr-1/IR-1 can work right away, thus collect EI sooner. And one has to watch how far in advance they quit....there was 1 person years back that quit wel in advance and since she quit so far..they denied her EI claim. I don't know the rules on that, just what I read here...and of course, 1 never gets the full story, lol
