Adj of Status After K1 Expire - Forms I485, I765

Timeline

I am preparing AOS forms for my wife. She came on a K1 and we married within 90 dys. The visa has been expired for several mos.

Now that we are doing AOS, for the forms I485 and I765 how do we show her status?

  • I-485, part 1, ques says "Current USCIS Status"
  • I-765, ques 15 says "Current Immigration Status"
  • I-765, ques 16 says "Eligibility"

I know these may be no-brainers, but I need to know for sure how to answer these questions.

I put on 485 (permanent resident) no problem

765 I put K1 fiance as that's what she entered as .

Last one I left blank but I think K1 are supposed to write C-9

C9 but ours was blank

1. Current status is K-1. You are not a permanent resident yet, and approved is not a status. She is currently a K-1 overstay.

2. K-1

3. C9

The answer the same whether the I-94 expired or not.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

I meant to say that the I-94 expired. Too late to edit title now.

Even if her I-94 is expired, you would choose K-1. And yes, C9 is correct.
