So the 2 initial toursit visa's were not for the intent of getting married. I just wanted her to visit my country to see if she would be interested in moving here. We were naive to the difficulty of obtaining the visa at that time. The reason it was twice was once while we were living together in Singapore (which was denied because she was not a PR) and a second time in Philippines where they decided that leaving her son behind was not strong enough ties to her country to guarantee her return. After that we decided to get engaged not knowing the can of worms which would be opened.

You guys need a lawyer who is an expert with annulment cases. I have a best friend who underwent that and it took him 10 months from the 1st court hearing to court decision.

Once she got annulled, you guys can do anything and everything freely and can file K1 or if you really really really love her and you can't wait any longer, marry her in the Philippines and file CR1 visa.

It's not as bad as it seems right now...

By the time she gets an annulment, and you file another I-129F packet, and it reaches the U.S. Embassy Manila, you will have had more than three years of an ongoing relationship with your sweetheart, and possibly several visits with her in the Philippines. You will have loads of proof of an ongoing relationship with her. That's a lot in your favor. Yes, it's going to take time and money, but it's doable.

When the time comes, go to her Embassy interview with her and both of you answer all of the questions honestly.

OP here are my thought could be wrong dont know it seems a complicated situation.

What country did they get married in?

If the Phillip govt accepted that marriage certificate from the 3rd country and registered them as married, I would believe getting divorce in the 3rd country and divorce decree from the 3rd country should be accpeted by phillip govt and thus anulling the marriage.

It might be diff but to me it seems your wife needs to get a lawyer in the country where they got married and get the divorce from that country, her ex-husband cannot hold her hostage. In most cases lawyer would send him the notice and he is not willing to accept the notice then a court would interfere and get this guy to be present in the court if he chooses not to show up in most cases judge would favour the party present in court and grant a divorce.

No "red tape" involved. He's just a regular office guy with a P15K - P20K monthly salary and a new girlfriend and kid to feed that time. After he got annulled, he married his gf.

:pop: The Embassy will not forget those previous applications.

It is very common to look at all previous applications denied or otherwise particularly in HIGH FRAUD consulate like Phillipines. :huh:

Here's a key issue when it comes to immigration::

Her marriage in Singapore was supposed to be ceremonial only and they were intending to have a "real" wedding in Philippines.

It raises questions. For example, how could she have been legally married in Singapore without applying for a marriage license and signing it?

Regardless of getting her marriage annulled in the Philippines you will have to explain to the US Embassy in Manila why you filed the first I-129f while she was still married.

There are reasons the Philippines is a Fraud Country and one of them is that it's not unheard of for a filipino to conceal current relationships (including marriage) to get a Kano to import her to the US.

You knew about her marriage and just thought that the Philippine government didn't, since she didn't actually apply for the K-1 the only issue there is the USC lying on the petition.

The tourist visa applications are another story if she concealed her marital status...

I was under the impression that having an "ongoing relationship" with a married person would do harm to a petition? If this is the case there is no where he would have 3yrs under his belt...i stand to be corrected
