Should a beneficiary arrested once in US but no conviction expect delays?

Look, even in Texas where you first shoot and then ask who knocked on the door, I think that chasing somebody with a deadly weapon is prohibited by the law. There is self-defense, but that has to be proportionate to the offense. meaning that if somebody attacks you with a fist, you can't stab him. if the attacker withdraws, self-defense ceases to exist. a person running away does not create a threat. he's leaving. what comes next is called retaliation. which is understandable, if not justifiable. certainly human, and many would react like you did. of course my statement is ignorant, because I ignore what happened in your house, whether these 3 gentlemen were holding a weapon in their hands themselves, what you were doing when they broke into your house, etc. etc. again, in a way or the other, you've been lucky. unhurt and out of troubles.

Care to point out the Texas law that allows shooting blindly at people through your front door? I've lived in Texas most of my life, and I'm unfamiliar with that legislation....

BTW... People take plea bargains all the time, simply because they don't have the thousands of dollars and the months or years needed to fight the bottomless pockets of the State prosecution. Not only that, but defense lawyers often counsel this course, realizing that a jury trial is always a risk, reguardless of one's guilt or innocence.

Self defence is a nebulous thing, and there are no guarantees- until you are put in a situation requiring you to use force, perhaps even deadly force, to defend yourself or another innocent person from a violent predator, I would stay off your high horse.

I wasnt chasing them as soon as they went out the door i shut it and held it shut for dear life. I think how i handled this was perfectly justifiable.

why did you take a plea bargain if it was self defense? a plea bargain means that you recognize you're guilty (you say it yourself, that you pleaded guilty), and in exchange of saving the state the time and money of a trial, you get a smaller conviction. by the way, are you the petitioner or the beneficiary?

it was what my lawyer recommended, it got lowered to a minor misdemeanor.

There is a question on the i-129f that asks if you have been convicted of any of the following crimes, then it goes on to list them. Since my crime was no on there I answered no to the question. I hope that was right.

I think people need to back off this guy. He asked for advice and he's being blamed for defending his life and others in his house. If someone breaks into YOUR home, can you honestly tell me you wouldn't do everything in your power to get them out?? And frankly, if there are threats being made, you have EVERY RIGHT to defend yourself in your own home. He has said that he chased them out of his house... not that he continued chasing them once they were out the door. Stop judging. We're supposed to be here for each other, not attacking and accusing one another.

Have you looked into expungement of the record? Depending on where the case was filed, it may be an option.

No will look into this but boiler has posted saying not possible for immigration purposes.

True the rest was kind of irrelevant but i felt i had to explain when people jumped on trying to make me out as the bad one.. I was on a J1.

Your Lawyer is full of XXXX ! Your Lawyer played a game with you. THINK FOR SECOND. You would never pay $500.00 for a charge and not a Conviction. If you are Convicted of a crime then the option of Expunging the the crime.conviction is there. But LISTEN. USCIS does NOT reconize Expungments what-so-ever.

Expungments are generally for small crimes (misdeameanors) that generally relate to employment background checks, petty theft of a US Citizen and of that nature.

Your Lawyer did tell you half the truth. They relate to Convictions but evaded telling you NOT WHEN IT COMES TO USCIS. You can hide nothing from this tenticle of the US Goverment.

I just said to the lawyer, someone mentioned expungment and he responded that expungement is only related to if you have a conviction. What do you mean 500? I didnt pay anybody anything? Im confused, lol. He didnt mention USCIS but he basically just wrote it off with his response anyway.

Your question about $500.00 on average is for expungement from the record but does not apply to USCIS.
