Just wondering what my options are for co-mingling of assets. From looking at this:

Other things you will need: passport-style pictures (see specification), copy of the passport, copy of the k-1 visa (and NOA2), copy of the I-94 form (both sides), copy of the fiance's birth and divorce certificates with translation, PLUS the supporting documentation for the I-864 form: letter from employer confirming employment, the last 3 years of tax returns, plus any documentation of your financial resources if you choose to include this. The rule is, if your income is not 125% of the poverty level for your family, you will need additional financial documentation. HOWEVER, if you read the form instructions carefully, it states that while they do NOT require additional financial information IF you have at least 125% of the poverty level, it says the USCIS can still ask for that information if they want... so in order to potentially avoid future questions, many people include financial information, including bank letter, letter from stockbroker, letter regarding mortgages, copy of deeds to a property, and any other financial assets... etc. It is far better to include too much information rather than not enough.

I make over 125% of the poverty level. I can provide letter from my employer, last 3 years tax transcripts, plus any supporting docs for the I-864, and bank letter showing joint accounts. I plan to get a joint membership to the gym I go to this week.

The mortgage is in my name, not in Pui's name. I have tried calling my health insurance company and they said it takes 3 - 6 weeks to get a new policy approved, which would most likely be after her I-94 expires. I already have all the utilities in my name. What other options do I have to show more co-mingling of assets? Thanks everybody.

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

You do not have to file for AOS before the I-94 expires, you can wait if you want more evidence

They do take some of these things into consideration, after all you have been married a short time and it does take time to change things. File it when you are ready and continue to get things changed into both names, etc. If you get an RFE you will have more evidence to send and you should have a lot more before the interview (if any)

But just to remember, there is NO RULE that you have file before the I-94 expires (there is no particular deadline to file AOS) AND you do not have to attach ALL suggested evidence with the initial filing

They will expect more for the RoC in 2 years than they do now.

AOs from K-1 is not required to show any evidence of a bona fide marriage in their package. I-485 instructions do not ask for such evidence.

If you make over the 125% level, you do not need to list your assets or provide bank statements, mortgage info, etc. Just provide your tax transcripts, letter from your employer stating your position and salary, plus a few of your most recent pay stubs to prove your current income.

You do not need to send any evidence of co-mingling of your finances and life with the I-485. The only evidence of marriage you need to send in is the copy of your certified marriage certificate.

Save up the evidence of your co-mingling to provide at your interview, should you even have one.

Aside from what you already listed as documents you have, we didn't submit anything else to support income. Regarding the co-mingling assets...we submitted copies of our lease, and utility bills (which I konw you don't have) and bank statement with Nan's name as joint owner. I know you can't change your morgage, but the utility companies should be able to add her name to the account, can't they?

With that evidence, we didn't get RFE and during our interview yesterday, they asked us to show the following originals:

Lease

Utility bills

Pictures (wedding, and mis pics since she arrive the US) They kept 2 or our pictures

Birth certificates (for both) w/ translations

My naturalization certificate

Passport w/I-94 and K-1 visa in it.

My divorce decree

Marriage certificate

She also asked us the below questions:

Asked my wife to state her name, address and phone number.

Has she even been convicted of anything crime?

Has she ever provided false documents?

Has she ever been deported from the US?

How did we meet?

Have I met her parents? (proven by pictures)

Have she met my parents? (proven by pictures)

Have I met her daughter? (proven by pictures)

Have she met my kids? (proven by pictures)

How many time did I visit Thailand before her arrival to the US?

For how long?

The whole thing took about 30 minutes and then she told us that she approved her green card and that we should be receiving it in the mail in about 2-3 weeks. I hope this helps. if you have any more questions, I'll be happy to help as much as I can.
