Well now that Riza has the nvc number and has gone to BPI, I am now sending her my papers for her hopefully soon interview. I have mentioned before that I am just above the poverty line. My gross on my tax return was 23,372. Some of that is unemployment. I also have about 1200 in child support that is not included in that which brings my total up to 24572. I work as a union millwright which is on again off again work. Sort of like seasonal. My son lives with me full time so my responsibility would be for 3. That would make my 124% poverty line 23,162.

I had 3 employers write a letter stating that I am a regular employee in good standing that works for them on a continual temporary part time basis. Included was my hourly rate and my date of first hire. I also had the Union hall write a letter explaining what our work field is and that it is temporary and I work for multiple employers on a continued basis. He also included current pay rate and when I joined the union.

I am currently working for one company so I put them down on the i-134. But I will not be shortly.... but working for someone else. Now do you think I should write a letter explaining any of this again? Also seeing as I am a single parent I do not work out of town very often. But when Riza comes I will be able to do that more often seeing as I will have more help in child care besides my parents. This would raise my income up even more than the current increase of work at Mines due to high metal prices. Or do you think a letter would only draw unwanted attention? I am above line.

My feeling is that if you make the 125% by even only $1 you will be approved. The number is harder on those in CA and NY than many other states where life is much cheaper. Even if you have a paper route to make up the 1% it counts. Personally I'd get a way to hit the 125% and leave it alone then. If you are at 124% only then I'd include a letter stating is work was seasonal, if a raise was due, or other expected changes in the positive direction.

ahhhh but I have found this. It says 100 % for the I-134. I read one post where at the interview they told someone it was 100% not 125. I thought perhaps it was just confusion on the workers part. Hmmmmm if so we are rockin GOOD!

US Embassy in Manila goes with the 125% poverty line, not the %100. You may want to add any assets or savings you may have to bump up your income level just to be on the safe side.

I'm not sure, but wouldn't you use the 2-person HHS poverty baseline of $14,710 instead of the 3-person of $18,530? I mean, you are showing PAST income, so if it's just you and your son, that would be the lower number. If so, then you are way good. If you are using the 3-person to include your fiancee, then as you said, you are good to go. Either way, best of luck. I think you have it "in the bag"!!

You have a household size of three...you, your son, and your fiancée. You will need to meet or exceed 125% of the poverty level for a household of that size. The U.S. Embassy Manila uses the 125% number for the I-134 Affidavit of Support because they don't want your fiancée to become a public charge, and because that's the amount you will need to meet or beat on the I-864 when you adjust her status (AOS).

Thanks for the tip. I have that all planned out, and work has been much better this year. My number one goal is to get Riza here and marry her. If need be that stuff can wait. As long as we are together that is the important part. :)

from every thing i heave read here on the boards they do not count unemployment benifits.

Apparently they DO accept unemployment. We got the visa. They did not ask a whole lot about income. They did ask her if I was working and she said yes. I just happened to be that week. We did get a review on our case. They did not ask for anything or seem to have a problem with anything. They said we just have to wait and they took her Passport and info for shipping the Visa and 20 days later it came. Weird. But we are happy and going ahead with plans.
