One of my witnesses didn't even start the visa process and the time I had my civil union and there was no problem.

April 21st, 2011 - Civil union in the US

July 30th, 2011 - Wedding Ceremony in Paris with friends and family

One of my witnesses was my brother, and he was visiting from the UK.

It looks as if requirements vary by state; a quick google search shows me that Virginia, for example, does not require a witness to be present, but that Texas does.

Is it mandatory that the person who witnesses a marriage ceremony be U.S citizen? Or is it acceptable if he were a permanent resident?

That's a question to ask at the office that issues your marriage license. USCIS doesn't care as far as immigration. If your state calls it a legal marriage, then it's legal.

It looks as if requirements vary by state; a quick google search shows me that Virginia, for example, does not require a witness to be present, but that Texas does.

Weird because there isn't even a place for witnesses to sign on a Texas marriage license. Only the officiant signs after he performs the marriage, then that is registered and becomes the marriage certificate.

Agree with Nich-Nick that that is a question you should ask when you get the marriage license. I know for me in Georgia, my Dad was one of our witnesses and he was just a visitor from Canada, no other type of status in the US at all. Georgia considers us well and truly married :).

I'd venture to say that if they had their legal capacity (not committed to asylum, or under the influence of drugs/alcohol) they'd be legitimate witnesses.
