EAD-will JFK still issue??????

I just heard that effective 10/1 they will NOT be issuing temp EAD stamps at JFK.

Has anyone else heard this???? I am posting an e-mail I rec'd from a friend who works at the Irish Immigration Center in Boston.

Not trying to strat a panic-just wondering if my man will get ot or not :huh:

USCIS Director Gonzalez's Memorandum Responds to

Ombudsman's EAD Recommendations

USCIS Director Emilio T. Gonzalez issued an internal

memorandum, dated July 20, 2006, responding to the USCIS

Ombudsman Prakash Khatri's Recommendation #25 on

Employment Authorization Documents, including EADs for K-1

nonimmigrants. The Director rejected the Ombudsman's

recommendation that USCIS amend the regulations so that

K-1 nonimmigrants are not subject to breaks in employment

authorization, ***stating that USCIS instead plans to

propose to eliminate employment eligibility for K-1

nonimmigrants in order to be more consistent with what

the memorandum describes as the underlying intent of the

benefit.*** The memorandum explains that USCIS does not

consider automatic employment authorization for K-1 visa

holders to be consistent with the temporary, nonimmigrant

and family-based nature of the visa which is intended to

enable the alien to enter into a valid marriage with a

U.S. citizen within 90 days after arrival.

Director Gonzalez also rejected the recommendation that

USCIS begin issuance of multi-year EADs, explaining that ,

with the exception of certain asylees and aliens who have

been granted Family Unity benefits and already receive

multi-year EADs, USCIS has determined that a one-year

period of employment authorization generally meets the

needs of aliens who are authorized employment incident to

their immigration status. Citing an interim rule that

permits USCIS to issue EADs for validity periods other

than one year, the memorandum concludes that it would be

"operationally impractical" to grant multi-year EADs in

accordance with the criteria outlined in the interim rule

in order to address a "temporary situation", considering

the "diminishing USCIS backlog and the decrease in

adjudication times for I-485s which is falling below one

year." The memorandum also discusses an approved plan to

issue EAD cards valid for two years to individuals granted

asylum by USCIS, stating that the automated EAD issuance

process available at the Arlington Asylum Office as part

of an initial pilot program will be fully operational in

all asylum offices by next fiscal year.

Regarding the Ombudsman's second recommendation that USCIS

issue EADs valid as of the date any previous EAD expires,

the Director's memorandum maintains that changing the

validity start date on EADs would require USCIS to abandon

automated batch processing of EADs and divert adjudicative

resources to interim benefit processing, but agrees to

assess the possibility of integrating synchronization of

EAD validity dates into the present system. Director

I have seen that announcement, there was a thread on Britishexpats a month or so ago.

JFK being the only ones issuing EAD's seems illogical, all or none makes more sense, but whether they will impliment it, only time will tell.

Have not heard this and do not know whether it's accurate information or not.

I do note that it's CBP that mans the POEs and that USCIS Director Gonzalez is not the man in charge of CBP.

As I said..........I certainly did not intend to sound any alarms, I just wondered if anyone had encountered a problem at JFK. Maybe they won't change anything at all about EAD's-who knows?

My man will be here in 3 weeks so I will find out soon enough.

I wished that everyone could get his/her EAD quickly, but it seems unfair to me that JFK would be the one and only place to issue EADs. Visajourneyers who can't go through JFK have paperwork to do, pay lots of money, and wait several months. I never got mine, but then again my green card is on its way. :)

The fee paid for my EAD still leaves me with a bitter taste in my mouth tho...

They don't have to. It's a choice that is available to them.

Be sure that you recognize the difference between EA and EAD, and the implications of the difference.

I thought on a K1 you did not have to apply for an EAD?

Ah, damn. We got delayed for our K-1 and I've booked the flight specifically to go via JFK on October 12th to try and get a temporary EAD.

I really hope I won't be out of work for four/five months (until I get my EAD under the AoS). That would really suck.

Yikes! I hope all works out for everyone... mine came through JFK on August 30th specifically for the EAD also, and received it with no problems. It was the normal temp one, good for 90 days... the only problem is you can't read the darn stamp, just looks like a nice red mark on the I-94, but seems so far everyone that needed to see it was able to recognize it.

I really hope I won't be out of work for four/five months (until I get my EAD under the AoS). That would really suck.

Someone came through JFK last week and got the stamp. I think the word "proposed" in the memorandum is good, because we all know how long it takes them to implement anything. I'm not worried.
