Hi VJ people. Got my RFE email from NVC just 2 days after they generated RFE. I was right,they are requesting more evidence becouse of my mistake.

On question 25 federal return tax information i was supposed to check optional checkbox but i didnt. Now they want me to file another I 864 with the tax documents they missing for year 2010.

I have tax transcripts for 2008 and 2009. For most current year i dont have it. I left the states for 2 years and didnot file tax in 2010. Didnt work or make any money.Got married etc...

My question for VJ people? If i file another I 864 can i check the optional box for the 2 most current years i worked and mail it to NVC? Is that going to affect processing in any matter or it is ok.Couse i will attach letter explaining where i was in 2010 year!

Two most current years of employment should be enoug to satisfies NVC or nor?

The item 25 of I-864 part 2 "(Optional)" is for the year 2009 & 2008 and not for 2010. The returns or IRS Tax Transcripts of 2010 (latest year) is mandatory, so your solution doesn't work and you will get another RFE.

I am not sure how you will have to resolve the 2010 issue - I think I saw an old thread addressing this issue. I will search and let you know and meanwhile I hope someone like Pushbrk will respond.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
