Pls advice is needed urgently

we need people to enlighten us on what to do and tell us about our chances.i am nigerian and my fiancee is the american.she is 15yrs older than me and cant have kids anymore of which i have none.we met about 15months ago and she visited me and lived with me for about 8months of the 15months and she has visited twice and hoping to come again before d end of sept.

i will like to know if the age difference can affect my chances of being with the love of my life at the interview stage,secondly she isnt working and just got approved for her ssi,in other words we need a cosponsor.she is suggesting her 19yr old nephew who has about 200grand in d bank in form of cds left for him by his grandpa,is he good enough to be used as d co-sponsor?...................we have been worried abt the chances going by the conditions i listed,pls peeps enlighten us more and advice us on what we can do,thanks peeps.

our petition is about 3months old n waiting on d noa2...she visits me in malaysia where i am located now but i am nigerian n my filing is nigeria addressed

Very Tough Consulate and your case isn't looking pretty. If you guys are truly ready to confront all that this journey will throw at you guys then you may just make it. Be strong,truthful and sincere...

Lagos is considered high fraud

Lagos doesn't really believe in "Love"

Lagos believes that once its NOT a cultural norm then its grounds for denial (Case in point; Africans love kids/Large families so, why would you an African man get involved with a lady who can't give you kids)

Lagos believes you are trying to get married just for immigration purpose

The fact that your future wife is 15yrs older and will not be in a position to have kids will be a major red flag. The question that may arise from this particular episode and your response will make or break your case.

I will try and look for cases on VJ similar to yours and post so you know what to expect.

The journey is already tough for folks without red flags and for those who have potential issues it can't be smooth sailing. Prepare for the worst while hoping for the best. If this was London or Canada you would have been just fine.

We went through the Nairobi Consulate...not the hardest Consulate, but certainly in NO WAY, the easiest. I was worried sick about the same question...I'm 8 1/2 years older than Ben ~ I can still have children, BUT I already have a 23 year old daughter. Ben has no children. I even got a note from my doctor stating that I could still have children just in case. I was very concerned. The Nairobi Embassy is known for giving people a really hard time (especially CR-1 visas, for some reason) although ours was a K-1. They never even asked the question. Over prepare yourself, and hope and pray it won't even be an issue. God Bless your journey.

The more time you spend with each other physically the better. Gather a lot of proof of your relationship. This will increase your chances of approval. But don't ever forget you are dealing with "the hellish US Embassy in Nigeria". They use their gut feelings to make decisions, and if there are "red flags", which obviously you do have in your case, address them in details before you go in for your interview. Support your red flag issues, when your fiance will be sending in the next package of documents to the embassy prior to your interview.

In regards to the co-sponsor you indicated, you will need him to co-sign the affidavit of support form. He can be used as a co-sponsor.

Thanks for your comment.nobody knows she cant concieve if i dont tell as she is only 43,d cosponsor issue i have is just that he is 19 but the money is there n quite much.we have an age difference quite alright but we been together 9months of 13months and she is coming to me in malaysia soon again for d 3rd visit.what do u think abt d times spent together and how much more do u think i can support my red flags?can i send a change of address so i can have my interview in malaysia?pls respond,thanks alot

The things I am refering to are the things you mentioned in your original post about age difference and your fiance being past the child bearing age. The only solution is to make your case air tight and pay attention to details....good luck :thumbs:

The age difference and the inability to have children (presuming the CO finds out about this) could certainly be a problem. However, I would think the fact that his fiancee is collecting SSI could also be a big problem. SSI is federal welfare, and is a means tested benefit. Unless she's blind, she's getting SSI because she's permanently disabled and didn't pay enough into the system to qualify for Social Security Disability benefits. In other words, his fiancee is already a public charge.

On top of this, her joint sponsor is a 19-year old kid with an inheritance. How long does it take a 19-year old kid to burn through a $200K inheritance? I would think one year of mildly opulent living would be enough, followed by another year of liquidating the assets he purchased in the first year. Most young people who receive an inheritance in this range are pretty much back where they started within two years.

I think there's a pretty good chance that the CO's at Lagos could just deny for the public charge requirement. If it were me I'd be looking for an older joint sponsor with a more stable income history.

If you have residence in Malaysia you may have your interview there but she will still have to get a co-sponsor before then. You will also need to get police clearance from Lagos and Malaysia for your interview. Having your interview in Malaysia "may" make some difference but you still need to fix the co-sponsor issue .
