Hi there!!! im japanese and i have been waiting for visa since march so patiently

with my 8 month old son, but even 2nd step has not done yet!!!! this is too long!!

anyways my husband is in tx hes in the army, and we just found out hes going to iraq

next month for over a year :crying: so i need to see him by all means before he leaves!!

i asked embassy if i can enter the us in this situation, they said yes as long as i can

prove that i sure come back to japan. but im kinda worried immigration might give me hard time.

so i wonder anyone did this before?? goin to see ur spouse while waiting for visa???

what should i bring to prove that i dont stay there??

and can i extend my entering the us after i get visa? til he comes back...

or i have to start over again later??

sorry my english is not right but im just desperate now!!

Japan is a participant in the Visa Waiver Program (VWP).

If you chose to visit the United States while under a K-3 petition, you will need compelling evidence of your intent to return to Japan.

Items that will help:

Return ticket

Lease or Mortgage documents

Letter from your employer, stating when hired, position and expected return date.

Car documentation (loan docs, registration, insurance).

Etc..

If your husband is being deployed to Iraq because of military service, can you the expidition process to further your case?

My wife has visited me on 3 separate occasions, all while our I-130 has been processing. She has never had any problems entering the USA.

But just in the case they ever questioned her, I had her bring "pay stubs" from her job, as well as evidence we are going through the legal immigration process (reciept/approval notice from USCIS etc....)

Fortunately, they have never detained her nor questioned her other than for the typical "How long do you plan to stay etc...." type of questions. She's never encountered any kind of problem in trying to enter.

April 16, 2004 Married in Saint Augustine, Florida.

March 7, 2005 Wife left for Istanbul to serve J-1 2 year HRR. Was a very bad day at Black Rock.

May 23, 2006 USCIS receives application for I-130

June 12, 2006 Noa1

Sept 7, 2006 Noa2 I-130 approved

Oct 10 ,2006 Received fee bill from NVC

Nov 13 ,2006 Received Packet 2 DS-230

Jan 4, 2007 Mailed Packet 2 to NVC

Jan 22, 2007 RFE from NVC aaarrrrgggghhh!!!!!!!!

Feb 28, 2007 NVC received "checklist" response and original documents for the RFE

March 13, 2007 Case completed at NVC! Whoooohoooo!! Ankara, here we come!!!!

March 15, 2007 Case fowarded to Ankara Embassy

April 4, 2007 Interview. Wife gets handed the little green paper. Not good. Need to submit a few more things.

April 9, 2007 Items mailed back to Embassy. Crossing fingers, rubbing the "rabbit's foot", etc,..that this may FINALLY be the end.

April 14, 2007 Visa delivered! Wife is finally going to be on her way back home!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!

today i asked my employer for my proof of employment..

do i have to notarize it even tho its typed in english by them already?

and i asked my hubby for his order for deploy too just in case...

talkin bout notary, all translated documents must be notarized by embassy??

they cost me like 20-30 dollars for each one :(

I've never bothered to have my wife get her employment paystubs....or letter from her employer notarized. I don't see where that would make that big of enough of a difference where it would be the deciding factor as to whether you are let into the USA or not.

For the costs of getting each one notarized, if it were my wife......I would tell her not to bother.

As I mentioned before, each time my wife has come to visit me, they have never asked to see anything. She was let in with hardly a question asked.

So, just going by what has happened each time my own wife has visited me, I would tend to say that there are other factors more important to the US customs, than whether a proof of employment was notarized or not. Chances are...they won't even ask you for it.

That doesn't mean you shouldn't come prepared........but within reason.

MPGGMP, it's not clear where your wife was coming from, or which type of visa was in progress when she came. While some people here have had experience with a spouse visiting successfully during the visa process, others have been denied. And being denied, and sent back to Japan, possibly with a baby in tow, would be devastating.

snowberrypie, I'm no expert, but if you decide to attempt an entry, I'd have as much documentation as possible, showing that you're likely to return to Japan (return ticket, letter from your employer stating when you're expected back, mortgage or apartment lease, bank and utility statements, etc.) Notarizing isn't necessary. It's about building a case that you're domiciled in Japan, with such strong financial and other ties, that you're likely to return.

Some people have brought documents showing where they are in the visa process. These can be further evidence that you intend to immigrate legally instead of illegally.

You could also bring proof that your husband will be leaving for Iraq in a month.

You have another alternative, which is to meet him in Mexico or Canada, where there'd be no possibility of denial.

That's why I ended what I said with the statement "That doesn't mean you shouldn't be prepared...but within reason"...........

I know people have been denied entry. I know and I am sure she knows that this isn't...unfortunately , a 100% sure thing, even for people with good and honest intentions.

Unfortunately, that's the system we have to deal with...for better or worse.

I just don't think she shouldn't try , or spend too much time worrying herself to death.

Overall...as stressful as it is for the person trying to visit, I have still seen many more successful attempts here on VJ......than non-successful ones.

And I personally feel...it's worth the risk. Then again...we all have our tolerance and risk level.

She'll have to make that decision for herself.

ill just bring the letter from my employer and his order anyway..i guess it depends on how lucky i am

if they question me or not..wish me luck!!! just got scared whe i heard people got rejected when they were

not supposed to. maybe i will report what happen later ;) hope u guys have happy life with ur wonderful

partners!!!
