Well, since i am filling out a i-864 and so is my mother (and my father filling out a i-864A) i would assume she is the only JOINT sponsor, as my father is merely a "household member" even though he's "offering" support, correct? so she is d. the only JOINT sponsor.

LAST questions regarding these stupid forms (I swear!!):

on MY i-864 for part 3, question 8: i check yes correct? on my mother's i864 she checks YES as well?

for MY i-864: my household size is 2 (both me and my husband) correct?

for my MOTHER's i864: her household size is 3 correct? (her, my father and my husband) although i WAS listed on her last tax return as a child dependent bc i was still in university--so would it be 4??

We had our interview today and got Blue Slipped due to the I864 problem. Originally I (unemployed petitioner) sent the I864 and my mother (joint sponsor and also a household member) sent the I864. The CO's comments were that he couldn't say what exactly was wrong (and quoted some law) but that I, the petitioner, needed to fill out a new I864 form to include my mother, form I864A. He then said my mother's form was correct.

We've been looking at the forms and I'm now even more confused. What do I now put for question 21G? One for me, one for my husband and now one for my mother? What about my father? He's in the household. He's not filling out any forms but he was counted on my mothers original I864 form. Now he doesn't count anywhere? Or does he now need to fill out an I864A form? Is this going to be another problem? Should I have my mother complete the I864A form and just resend her tax returns and W-2s?

Any help would be appreciated as I thought I had this understood and now am really upset.

I strongly suggest that you open your own thread.

Your mother filing I-864 is correct, as agreed by the CO. Now you need to clrify in your thread the following before anyone can guide you.

  1. Does your mother and father file jointly!
  2. Are there any children dependent on them! and used by them as dependents!
  3. Does your mothers wages or income is suffient to support your foreign spouse! or does your father's income also is required!
  4. Did you submit the IRS Tax Transcripts or copies of the full tax returns!
  5. Did your father file I-864A!

Your ned to open your own thread. Otherwise things get mixed up.

You still have to file I-864.

Your mom will file I-864 and your dad will file I-864A (or dad I-864 and mom I-864A). Your dad is the household member in your mom's I-864 and needs to be in item 24 b. Income of 24 c. needs to match the AGI (Adjusted Grioss Income) of their joint tax return (it is in the middle of page 2 of the IRS transcript or in item 37 of 1040 filed).

Check both "I am sponsoring....." & "YES" in item 8

Im not an expert on this but I live with my parents and they file jointly all the time. I used only my fathers income and when i filled out the forms he was my household member not co-sponsor. Do not forget though that if she is your household member you have to also send proof that you two are related.

Im not an expert on this but I live with my parents and they file jointly all the time. I used only my fathers income and when i filled out the forms he was my household member not co-sponsor. Do not forget though that if she is your household member you have to also send proof that you two are related.

one has to have proof that two household members are related?!! you've got to be kidding...what do they want blood? :blink:

as per advice, i am having my mom submit i-864 as my joint sponsor and my dad the i-864A has my MOM's household member since they file jointly.....even though i actually physically live in the same house as them, i believe that's an easier way to go about it.....

so, does my dad need proof that he's my mom's husband? or does it not matter since she's only a joint sponsor? pffff c'est ridicule!

it actually is I got an RFE because I didn't send proof of my relation to my father (in my case i sent a birth certificate)

I just had to do that again and send it back.... You are ALWAYS the primary sponsor... So the person helping you is the household member... And make sure YOU fill out the i864A form... I filled out the I864 and they made me do it over ... :( hope this helps!!

Those are optional and if one has a joint sponsor, those all the more are not necessary.
