I arrived in the US as a K1 Visa holder. My man and I got married on the 3rd week of August and are now preparing to submit the paperwork for

the AOS. We live in Minot, North Dakota. The nearest USCIS designated surgeon from Minot is about 2 hours away.

We called the civil surgeon's office today and was told that the earliest date that they can schedule us for the medical exam for the USCIS is on

October 11. And my visa expires on Oct 22nd :S I have a few questions with regards to the AOS medical examination.

- What should I expect on the medical exam? The doctor's assistant told me that I needed to take the tuberculosis skin test and syphilis test.

Did your doctor performed these tests on you too?

- How long did the medical examination plus the results take?

- Does the medical exam need to be conducted by a civil surgeon who has been designated by USCIS?

You should not be having a second exam.

K-1 visa entrants do not have second exams. The only thing that would have to be done is vaccinations and having the vaccination form filled out by a civil surgeon.

Also your K-1 visa expired the moment you used it. It is void. You should be following your I-94 expiration and be married within 90 days. It does not matter if you send your AOS after the I-94 expires but you want to send it as soon as you can so you can.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

I presume that you still have the form from St. Luke's? It says that if you had your medical within the year, you do not have to take the medical exam again. Some people was approved without that, some people get an RFE.

I suggest just sent a copy of the form from St. Luke's together with all your other documents and expect an RFE, go to your civil surgeon appointment on October 11, if you won't receive an RFE... thats good, if you will, then you will be ready.

- I got a tuberculosis skin test, the medical exam is just a few minutes, at least 15 minutes. (BTW, we have a lawyer and when we told her that we went to the civil surgeon, she said that it was not necessary, like I said above, some people did pass their AOS without the civil surgeon thing, some people got an RFE for it)

- it took me 3 days coz you have to be back within 48-72 hours after they ####### your skin for the tuberculosis test.

- yes, the civil surgeon has to be the one designated by USCIS

When you go to your exam, bring also the copy from St. Luke's and the copy of the x-ray coz if the civil surgeon has the software to see your x-ray, he might not perform the skin test, or if you can have the CD printed, so that you will have a copy of it to show to the civil surgeon that your x-ray is clear, therefore you do not need the skin test.

Lastly, there are 2 civil surgeons that is around 2 hours from you, did you contact them both?

You do not need another medical exam.

#2 What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or

B. as a K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and

C. You received a medical examination prior to admission, then:

  • a. You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with the terms and conditions on the waiver.
  • b. Even if a new medical examination is not required, you still must show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit Part 1, Information About You, Part 2, the vaccination chart and Part 5, the Civil Surgeon's Certification, of Form I-693.

My wife went to a civil surgeon in Florida and he advised us to have the skin test and a blood test and a brief checkup since many recieved RFE for not having done so . I know many said that you dont need one .I played it safe and had it done and the vaccinations transcribed since the DS form from Manila said ''Incomplete''. It took 3 days since we had to go back for the skin test reading .

My doctor tried to lie to me like yours as well. I said no. Guess what, no RFE and no interview got my GC in less than 3 months. It is NOT required for a K1 via a valid medical done in their home country. The doctors just want money. That said, there WERE issues with it a few years ago (maybe 3) back when the TB requirements for AOS in-country were new (2008 I think it was) and the drone processing packages didn't know what they were doing. It's all fixed now. If someone gets an RFE it's usually for a missing medical or shots not complete. Usually the missing medical.

Many civil surgeons lie and even refuse to do the transcription without you paying for a full medical that is unnecessary. It is not a requirement when adjusting from a K-1. This is why it can take some calling around to find a civil surgeon that will do just the transcriptions without trying to give you more uncalled for medical tests and overcharging you. The RFEs I see listed here on VJ are mainly for the original medical being missing from their file. For some reason, people's medicals go missing from the time they hand in their sealed envelope, to the time it lands on the adjudicator's desk.

CS in AZ recommended blood test, TB test, read x-ray and record review, we did and it was accepted. Better safe than sorry. Nice sealed medical envelope with GOLD seal. I put her on my insurance after marriage it covered the medical part but not his documentation. Delayed filing by a week.

Of course it's going to be accepted, it's just not NECESSARY.
