Hi all,

My wife is not a US Citizen yet but once she becomes a US Citizen she would like to bring her mom, dad, and 3 siblings (under 18yrs)to live in the USA. What is the way fastest way to bring them in?

1) Should she do all of them all at once or should she just file for her mom first and once her mom live in USA, her mom can file for her husband and 2 kids?

2) How long does it take to petition the whole families?

3) How long does it take to petition just the mom or dad?

4) Can I (a son-in-law) petition them to come live in usa?

Thanks

Thanks for the link.

So it's best for her to petition her mom first then once her mom is a permament resident, have her mom petition her spouse and 3 childer. This is much faster than her petition all her family members.

when will your wife file for citizenship and how old are the kids? because if anyone of them turn 21, it will take a very long time.

if not, then once she is a USC she can file for her mom and dad, then they can file for children. but for children under 21 of LPR can take over 3 years, if they turn 21, then it will take over 8 years.

This is a personal choice. Wait years together to immigrate at once, both parents come first, or one parent comes first. The quickest route requires at least one parent to immigrate first.

2) How long does it take to petition the whole families? Years. It may be 5 or it could be 10. It's impossible to predict. You can only guess how long based on how long people who are currently immigrating have had to wait. It also depends on which path the family chooses.

3) How long does it take to petition just the mom or dad? 6-12 months

4) Can I (a son-in-law) petition them to come live in usa? No. No one can not file for an in-law.

Thanks

Here is how long it currently take to petition for the following people.

Immediate Relative: US citizen petitioning a parent: 6-12 months. Derivative beneficiaries are not allowed - only the petitioned parent will get a visa. Children listed on the I-130 is for biographical information only - they are not eligible for visas.

F-3 Family Preference Category: US citizen petitioning for a sibling: 11 years. The sibling's age and marital status is irrelevant. Derivative beneficiaries are allowed, so this beneficiary can have his/her spouse and unmarried children under age 21 immigrate with them.

F-2a Family Preference Category: LPR petitioning for an unmarried child under 21: 3-4 years. Child must stay unmarried - marriage before entering the US voids the visa. If the child turns 21 years old while waiting for a visa, the child ages out into the F-2b category.

F-2b Family Preference Category: LPR petitioning for an unmarried child over 21: 8-9 years. Child must stay unmarried - marriage before entering the US voids the visa.

============================

Here is my recommendation:

US citizen wife files separately for one of her parents. One immigrates to the US. The other parent stays to care for the children. (1 year)

LPR parent files separate petitions for the children. About a year before the children's PDs are expected to become current, wife files for the other parent. These will be separate petitions, and you may be able to get the US Embassy to coordinate so the parent and children can immigrate together. (3-4 years if the children do not age out) (8-9 years if a child ages out)

She can file 90 days before the 3rd anniversary of receiving her green card - so more around 9/2012. She is allowed to file 90 days before she is eligible to become a US citizen based on her marriage to you.

Another thing to think about in preparation is health care for her parents. Depending on their age health insurance will be quite expensive.

Will they work?
