Joint Sponsor for I-864

Hi everyone,

My husband and I are looking to get a joint sponsor, as he is currently in law school and we have a relative who is willing to be a joint sponsor. Before he agrees, however, there are just a couple of points he'd like clarification on. My understanding is that a joint sponsor is jointly sponsoring the beneficiary (i.e me) along with the primary sponsor/petitioner (my husband)? So therefore, if I were to become a public charge, by claiming welfare benefits or incurring a debt, the government authorities would first sue my husband to recover any money I owed, and if they could not recover it from him they would seek to recover it from my joint sponsor. However, assuming that I have a steady income or sufficient assets so that I am not a public charge, but my husband defaults on his student loan, let's say or incurs a debt, is the joint sponsor liable for any money my husband may owe, even if I have not become a public charge? As I understand things, the joint sponsor is responsible for me, in the event my primary sponsor can no longer support me but not for the primary sponsor? Thanks.

correct, but student loans are not government means tested benefits, it's only if you owe means tested benefits.

not if your husband owes something or cannot take care of you. he has many ways of government assistance being a USC

Yes, the joint sponsor is responsible only for the beneficiary and not for the primary sponsor. Yes, his liability comes in to play only after the beneficiary and the primary sponsor.

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Thanks for your reply, and for letting us know that my husband has many ways of government assistance, if he needs it.
