It sounds to me like he's more than eligible for the exception so I would go down that path if I were you, and i don't think it requires the filing of an i-601, just an appeal citing that rule.

I'm pretty much the same way as Amanda and Josh. I read this thread when it first came up but I didn't really know what to say. I hope that things work out somehow for you guys and for your health as well. =/ Have there been any new updates on your case yet?

Thanks for the support. that is what my lawyer said as well and he contacted the embassy today. Just waiting to hear back now. CROSSING OUR FINGERS!

I can't imagine this not working. I love my fiance so much and hope we don't have to do long distance any longer. this process is already long enough!
