Hello,

I got admission into an US University for Masters program (Spring 2012). But I am going to get married by this year end and my fiance is a H1B visa holder. My question is can I study on a H1B dependent visa or its better to go on with a F1 visa. Please suggest which visa type should I opt for.

As a H1B dependent, you will be granted the H4 visa which will allow you to study in the US. However, you will not be permitted to work. With the F1 visa you may be able to work on campus for up to 20 hours per week and that way you can help out financially. On the other hand, the CO might deny you a F1 visa since you have a spouse in the US. So, it's up to you to decide which course of action is best. Hope this helped! :thumbs:

As a H1B dependent, you will be granted the H4 visa which will allow you to study in the US. However, you will not be permitted to work. With the F1 visa you may be able to work on campus for up to 20 hours per week and that way you can help out financially. On the other hand, the CO might deny you a F1 visa since you have a spouse in the US. So, it's up to you to decide which course of action is best. Hope this helped! :thumbs:

It will depend on your schools DSO, CO dont mind issuing F1 since they know you are elibible for H4 anyways.

Lot of the school and USCIS dont like anyone attending school on H4, since it is not the purpose of H4.

lately USCIS has made it clear they dont like ppl doing anything different then what they are supposed to do on the visa that they have.

If you are interested in going to school you should apply for F1, another thing to note is its still your fiance you are eligible for H4 until you are married.

NO

You are NOT reading what others are saying...F1 is for studying...if your intention is NOT to study...F1 will get not be valid!

F1 is for studying if you dont want to study then you should not enter on F1. If you stop going to school on F1 you would be considered illegal unless you have changed your status to another type of visa.

My advice would be don't just rush with any visa to be with your fiance, even if it takes little longer and you have to wait and get right visa before you enter US.

As I have said in my earlier post for you to get H4 you will have to be married - you cannot get H4 as fiancee.
