Hi,

We are in the process of gathering info for our I-130. I'm in Thailand now, returning to America in six weeks without my partner. I'll return to Thailand for her interview several months down the road.

I've read we will have to have a police background check and medical exam for my partner prior to her interview.

Are these things we can do now ahead of time, before we have even filed our I-130, so I can accompany her and make sure we get the paperwork we need from the police station and doctor? I guess what I'm asking is, is there a time box around when the police background check and medical exam need to take place?

If she has to do these two things on her own when I'm still in America it will be a challenge. She's from a small village in Thailand that doesn't have a police station, or full-service hospital. It would be much easier if I could accompany her in the next six weeks and make sure we get exactly what we need.

Any ideas?

I-130 takes around 3 - 5 months for approval, so first concentrate on gathering the documents/ evidence required and don't worry at all about the NVC process now. After submitting the I-130 petition, check this link http://www.visajourn...nal_Visa_Center

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

The process can be intimitaing & confusing at first. You are in the right place here at V J.

It would be a mistake to try to do what you are asking about at this time. You havent filed the 130 so can look forward to many months of working on the process & enduring the journey. The medical & police report arent usually done until the latter part of the process. That means about 7 to 12 months from the time you file. If you do them too early they may have to be done over. The medical for example is very expensive.

Many of us are from these same small villages. The police report is done by the BKK police not her village. This can be done by mail when the time comes. The medical is done in BKK. It can be done as I did it which was the day before my interview.

Look thru the forms while you are there. There are a couple she could sign right now. Then begin to study what comes next. Try the guides at the top of the page here. Best to concentrate your efforts on a step by step plan to work thru the process.

There are many experianced people here on V J that are ready to help both of you as you go forward. Nothing happens fast & its almost never too late to repair a mistake if need be.

Work on I-130 and ask us, if you have any specific question/s - don't waste money on lawyers.

Keep in mind a lawyer is simply an expensive information filter. You would have to gather all the info required for the forms to forward to the lawyer. This creates a potential problem in the process timeline.

Beware especially of the Thai lawyers. They have a terrible reputation that has been earned case by case. The embassy officer told my husband that the Thai lawyers were the worst they had ever had to deal with.
