Getting divorced next week. ROC

Hello All,

I would like to receive some expert advices and suggestions on what I am in right now.

I am about to send my application for removing of conditions by the end of September. My green card expires on 12/20/11. Right now My wife is in

process to file divorce hopefully sometimes in this week which i hope going to be amicable divorce. As she said, she wants to make it simple

and painless.

I dont know what to attach with my ROC package. our marriage was in good faith, for which i have loads of proves to show.

But I would like to know what sort of proves, evidence and supported documents i would need for my ROC package.

Any help would heartly appreciated.

Plenty of others who divorced and successfully removed conditions - do a search on it - it's right there.

Well, if you filing to remove conditions on your own as divorced, the divorce decree is required to be submitted with the I-751. And if not submitted, you will get a Request For Evidence (RFE) to submit the divorce decree in 87 days.

Since your gc is not expiring until 12/2011, you may need to wait a little longer until the divorce is finalized. If not finalized until 12/2011, then you can file 1-2 weeks before the gc expires, so will have an additional 3 months to send the divorce decree. I hope this makes sense to you.

With the I-751 petition, submit as much evidence from the last TWO years proving your financial co-mingling: taxes, leases, bank statements, credit cards, insurance, utility bills

birth certificates if any and anything else you can find with both of your names. The divorce decree also needs to be included as it is very important if you are filing ROC as divorced.

Thx for reply at this time where my wife is dragging me into hell. I entered in this marriage with a good cause but things sometime don't get along with you. Extreme bitterness and abuseness were the only factors of this relationship but when I realized it was too late. Right now the situation is that we still have joint macys, bjs membership but since she is in process to divorce me she took away my cards too and when I asked today to give me the cards cuz I need to use them for my ROC paperwork she made an excuse that she cancelled them already ....I know she have them but she is cutting down on the proves that we ever had joint account or whatever she has in her mind ..god knows I have no.idea. the only stuffs I have is joint lease joint bank.account started from 2009 until may 2010 Chase bank. Reason of until 2010 is that Chase was being introduced some new policy to have some amount direct debited into the account which we both wasnt fuilling the requirement that's why we closed that joint account and opened separately. I have photos from marriage upto now, also joint car lease which she soon to kick me out from the lease as per her said. I know it can't be done just like that but as she pays for the car payment and insurance then I don't know if she is capable of kicking me out of lease. These are the only asset I can produce at the time of sending my ROC ....please reply me with ur opinion what should I do from here. I can truly understand its a big drama but im suffering and need ur expert advice

Even though the credit cards may have been cancelled, if your name was on them, you can still call Macy's and ask them to send copies of the bills for the last 2 years. If your wife removes your name from the lease, just call the the place you leased the car and try to get a copy of the contract which included both of your names. Also call the insurance company and request copies of your policies and bills for the last 2 years. Try to get your hands on all the evidence you can get right now before you/she moves out.. Paperwork seems to disappear when couples divorce!!
