I filled an affidavit of support for my brother when he applied for his dv 2 years ago, but i am currently filling I 134 for my fiancé and i don’t know how to factor my brother in. do i see him as a dependent even though i did not claim him on my taxes and he is gainfully employed. I am asking this question because i just have enough support for two since i am full time student. i want to know if i have to get a co sponsor. Even though question 9 on the form does account for that the question becomes, what effect does it have on my income. Thank you for your help in advance.

I also filled an affidavit of support for a friend last year for his DV lottery processing and recently filled two more for my parents. According to immigration laws, my friend will count as my dependent (just for immigration petitions and not taxes) for 10 years or till he becomes a US citizen, which ever one comes first. Due to that, my household size on the recent affidavits of support I filled ended up to be 4 (friend, both parents, and I). Luckily, I work a lot, even as a full-time student, so I make enough to meet the minimum required for a household size of 4.

If I didn't make enough, I'd ask my friend, who's now gainfully employed, to serve as a co-sponsor since I did him a big favor that negatively affected me. You may want to consider that option.

so then what makes the household? is it my brother and i plus my fiance or just my brother and i. in short do i count my fiace as part of the household since she is the intended benefiiciary.

The I-134 is a little different from the I-864. On the I-134, they don't ask about ur household size, unlike the I-864. On the form (I-134), u are asked about anyone who depends on u for support. When I filled it for my friend, I put "none" cuz I didn't have any dependents on my taxes.

What I know is that, if I HAD TO fill the I-134 for my parents, then for dependents I will put "none". The next question on the form asks about people I have previously filled an affidavit of support for, and that's where my friend's info will go.

yes the question then becomes, how much will be appropriate for me, the person i helped a year ago, + my fiance(when she have a interview), reason is i want to make sure that i am reading the 125% poverty guideline correctly. so even though they don't ask directly, u have to know to be sure of what u are giving out.

That will be 3 (the person u filled for before, ur fiancé, and u). Basically, what this means is that u need to make enough to support a household size of 3 to fill the affidavit of support for ur fiancé. Per immigration rules, u are already considered to have a household size of two (the dv winner u filled for + urself). Ur fiancé will then be considered ur 3rd responsibility, and that's why u need to make enough for a household size of 3 (based on 125% of the poverty guideline).

Word of caution: from a few people's experiences I've read here on visajourney, it looks like the consular officers in Accra sometimes make subjective decisions regarding the minimum income required on I-134. That means even tho u may make enough for a household size of 3 and fill for ur fiancé, they can still reject the affidavit claiming u don't make enough. It sucks, so I'd suggest u get the dv winner to co-sponsor ur fiancé (as back up) even if u make enough for 3 people per the poverty guideline.
