I am a uk citizen visiting my girlfriend here in the USA. WE have decided that we want to get married immediately, while im here on a visa waiver programme. Does anybody here know what pitfalls we may encounter if we do this? .

We intend to get married and apply for AOS immediately. Ihave no reason or desire to to return to the UK, is this an option that is open and readily available to us. we are in California, but would be moving to Arizona, would it be better to marry in Cali-or AZ?

Many people go this route, but the burden is on you to prove that you did not enter the US with intent to marry. You will almost surely be asked about this at time of your AOS interview and if your answer is unsatisfactory, you will be denied. You may want to have a consult with an immigration attorney before making a decision.

You will definitely want to consult with an attorney before you decide you should attempt to adjust status without leaving the States.

You should also know that in the event your application to adjust status is denied, since you entered on VWP, you cannot appeal the denial. This is important to know.

Only you, your partner, and an attorney can make the determination as to whether or not attempting to adjust status is a good idea in your case. It might be, it might not be. If it's not, you can get married, go home to the UK, and begin the process of the K-3 or CR-1 visa.
