Good day!!

My uncle just got denied applying for tourist visa just by looking at the pending petition of my uncle. No further questions were made. My aunt in the U.S (here sister) made a complain to a senator and is now sending a letter in the U.S. embassy and so she wants my uncle to re-apply again. They just got an interview last Aug. 25 and wants to re-apply again as soon as possible. My question is, Can they do that now? Or are there any specific interval before you can re-apply again??

He can apply as often as he wants. He needs to show strong, strong ties to home.

He can apply as often as he wants. He needs to show strong, strong ties to home.

An immigrant petition filed for him does not help him get a tourist visa. A senator's inquiry will not change things very much.

I forgot. I just wanna clarify if you meant by "as often as he wants" does that mean anytime without any interval? or as often as he wants but wait for a few months??

He will never get a tourist visa with a pending petition. Thats why they didnt even ask him a question. Its true that he can apply as many times as he wants but the outcome will be the same. They will see that he has the petition & the past denial & simply deny him again. It would have been nice if they explained the reason for the denial to him.

Its also true that showing stong ties would help his case but I doubt he could prove it to them that he must return.

The complaint to the Senator will produce a letter thanking them for inquiring & future requests for funds for re- election. Senators have no power over the decisions of the embassy. The letter to the embassy will probably go unanswered.

He can apply again at anytime. Meaning the same day he was denied if he wants. The reason for the denial needs to be fully understood before another attempt is made.

Your aunt can complain all she wants, it's not going to matter. The US Embassy/Consulate has the final say on tourist visas. Their decisions are final and cannot be appealed. Your uncle has to show strong ties to overcome the presumption that all foreign nationals who wants to enter the US has the intention to immigrate. If your uncle cannot overcome this presumption, he will not qualify for a visitor visa.

If someone wants to get a tourist visa, he needs to show that he has no interest in immigrating to the U.S. If somebody already has an immigrant petition in the works, that's pretty much a dead stop. A virgin cannot work as a prostitute nor can she give birth to a child, even if the Bible wants ignorant people to believe that. An intending immigrant cannot prove that he does not want to immigrate, not even with a senator's help.
