Hi,

I am a filipina mother currently living in Quezon City. I just recently received an email from the NVC stating that they need 3 documents for my son which are the police records, birth certificate, and his passport and once I send all this information in I have to wait another 20 days for an update on our status. The current birth certificate I sent which was a late resignation birth certificate they said its not original or an official copy. I'm kind of losing hope and patience so what I am asking is when can I expect to finally leave the Philippines and land in America? If it is too late to get my son to come over at the same time as my 2 daughters and I, is it possible leave and have a schedule without him and continue his petition while I arrive and work in America or do we all have to come at the same time?

My pd is sept2003. My mother petitioned me in 2002 on an F2B immigration. When can I expect arrival to America if all our papers and information are fully submitted except for my son?

How old is your son? If he's under 16 then he doesn't need a police (NBI) Clearance. Are you not able to get a birth certificate on NBI Security paper for him?

As a derivative beneficiary he has up to 1 year after your visa is issued to have his Visa issued, it's called Follow To Join.

My son is 17 years old and his birth certificate is currently being processed. So with that being said about me having only 1 year to fetch him, you are saying it is possible for me to have my interview and schedule now since all my papers are correct and fetch him when I arrive?

Forgot to add some information.

Would my son still be eligible if me and his father weren't married when we had him(I never married anyone to be exact)? Also my mother is not yet a U.S. citizen. Does that help at all about the follow to join process? Are we still eligible?

My understanding of Philippine law (from reading this forum) is that because you and his father weren't married that you have sole custody, which means you don't need anybody elses permission for your son to immigrate. Other than that, it has no effect on his eligibility.

All family preference "F" visas allow for derivative beneficiaries to receive a visa. A derivative is a spouse or minor unmarried child under 21 years of age. In your case, there could be no spouse because you wouldn't be eligible for an F2B if your were married. But your unmarried children under 21 are eligible.

Any child who is eligible for a derivative visa can apply at the same time as the principal immigrant (you), or they can apply later as long as their visa is issued within one year after the principal immigrant's visa is issued.

Hi kabayan. First is your son's birth certificate has to be authenticated by NSO sa atin. If the late registration is finished which means the agency or municipality that processed the late registration will forward the papers to NSO. Follow up with NSO by calling their helpline. The # is like 737 1000, check it. This is the official birth document.

Second is the information that you have 1 year to fetch your son is actually 1 year to sought or process his visa papers and it's reckoned from the date when your priority date became current. just keep on communicating with NVC and comply with the requirements and I think your son's visa should be fine.

Yes, you can complete your process and your daughters now then your son's within 1 from the date your Visa is issued.

If you are worry about being wasting time trying to get all the paperwork together for your son, and if you have enough time to get him here together with you, don't be.

You see, as sep VB for the Philippines they are working on cases filed before 22MAR2001 which means you have enough time to gather all the paperwork they are asking for, there is no need to leave him behind.

You see, as sep VB for the Philippines they are working on cases filed before 22MAR2001 which means you have enough time to gather all the paperwork they are asking for, there is no need to leave him behind.
