I am finally at the stage where I send in the I-864 and want to get it right the first time. I am living with my brother and his wife, and he will sign for me as I have no income currently. My question is - I know I must fill out the I-864 form, with tax returns, but does he also have to fill one out? I will also fill out the I-864A and send that in with both our signatures, but I don't know if just the one form would be enough, or he needs to fill out the I-864 also. Thanks for any help on this, I can't get a straight answer.

you will file the i864, he will file the i864A, not you.

you can only file one form each.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

OP: You will out your own I-864 (as you already know), your brother will fill out his own I-864 as a joint sponsor.

The brother fills out the I-864a since they're in the same household. Not sure if you just missed the 'a' or not...

I didn't miss the A. Even though the OP and the OP's brother live in the same household, the OP's brother as joint sponsor can still complete the his own I-864. Furthermore, because the OP and the OP's brother live in the same household, that allows use of the I-864A but does not require use of the I-864A.

I mentioned only mentioned the OP's brother completing his own I-864 as a joint sponsor because that was the simplest suggestion I could offer. I know there are nuances involved with the I-864A that if I were to try to elaborate on, I would not know what I was talking about and that wouldn't do the OP or anyone else reading this thread any good.

Hmm, I had always thought that a household member HAD to fill out the I-864a. I didn't know that they had an option of filling out the I-864. Well then, learned something new today :)

Petitioner has zero income. So joint sponsor needs to do the 864 as well to give a better representation of their household size.

Thanks for the help everyone! I appreciate it, I will just have him do the I-864, and no need for the I-864A, as him filling up the I-864 covers everything. OK, one last question for Anh map, it's about Question 21, so I know your the man for this job already :D - first let me explain the situation, My brother lives alone with his wife. I will be living there with my wife and our 2 year old son. Correct me if I'm wrong, but my I-864 household size will be different from his? If I claim A = 01, B = 1, C = 0, D = 01, E = 0, F = 0 and G = 02, That's a total of 5 for me. My brother's will be A = 01, B = 01, C = 01, D = 0, E = 0, F = 0, G = 01, That's a total of 4 for him, does that sound correct?

Is your child a USC?

Your household = 3 (you, spouse, child)

Brother's count = 3 (bro, sis-in-law, your spouse) If your child is not a USC then the child needs to be sponsored so Brother's count goes up by 1 for the child.

I know somebody who does this spousal visa paperwork for a living and they are saying the household size would be every member in the house. So for me it would be myself, wife, son, brother and sister in law. Same for my bro. Yes, my son is a US Citizen. What gives here? I want to get it right the first time.

Sorry for the late response. I agree with Ryan - it is best for the joint sponsor to file I-864, as it leaves no room for NVC to issue any RFE (I-864A is best to be used by joint tax filer when the joint tax filer's income is also required).

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
