as we all know,ive been on VJ through out my whole visa process and thanks to this website i like to think of myself as some kind of...well pro in simple and normal cases.

our visa process was a difficult one because of the wrong and at times unnecessary information users share from time to time.case in point,the other day i was going through k-1 form,trying to catch up with the new information and possible changes that i thought uscis might have made.i came accross a post from a member asking about information regarding AOS and how long the time frame to file aos in was.some member mentioned that AOS has to be filed before the visa expires which is wrong,because its true that if you dont file for AOS before your visa or other cards and information expire,the time you spent in the US is considered over staying,but its forgiven base on the marriage when you do file for AOS.

needless to say when i saw that i started doubting and wondering whether or not that was true.

to sum it up,i spent 4 sleepless nights looking for that information,so from an old member to the new ones, double check each and every piece of information you see on this website

I think that should go without saying. The vast majority of people on here are not immigration lawyers and can only speak based on their own experience. Nobody here should take any posts as 100% fact without doing any additional research.

Was I involved in that conversation? :blush: Because I posted something like that and was corrected by another member in the same forum and how grateful I am for that. It is true, none of us have much experience outside of our own and I think common sense says you should look at information here as well as other places until you are certain you have the correct info. But these forums do give us the opportunity to learn, share and teach others. But again common sense should prevail and everyone should check and recheck the info they read here and correct others when the see an error.

The good thing about public forums is that bad information can be corrected. That particular has been covered ad nauseum here. But to state again

K-1 visas do NOT expire unless you do NOT enter the USA. If you enter the USA the K-1 is CANCELLED upon entry. It is replaced by the I-94 which expires in 90 days. In order to adjust status from a K-1 visa you MUST get married before the I-94 expires. There is NO particular deadline to file AOS. I am aware of several cases where the people waited more than two years to file the AOS and had no problems.

Clearly it is better to file sooner for the benefit of the foreign spouse, but not necessary. DO NOT leave the USA until you have a green card in your hand if you have been here more than 180 days past the expiration of the I-94 without filing for AOS.

When browsing the forums, read several threads on the topic and get the consensus of experienced people. Do not ask for immigration advice in PMs where the answers cannot be reviewed by other members.

Thank you!!! I was trying to say that in a post I made about AOS and the 90 day time frame issue. I had read on here you don't have to but then read other people say it does have to be and even found some misleading wording in the guides on here. There is so much to learn about the process that it is hard to keep it all straight let alone adding in people who think they know. I wish USCIS would have more info on their site but I suppose if America is known for anything it is now known for not being easy to immigrate to-why would USCIS want to ruin that reputation!

8/12/11 Called USCIS to get receipt number-NOA1 will be resent

8/16/11 Received NOA1 with date of 7/20/11

Correction, overstay is forgiven when AOS is APPROVED, not just applied for. If AOS is not approved then the overstay counts. There are many cases where the USC pulls out and doesn't AOS with the immigrant. For the immigrants peace of mind AOS should be applied for before the 180 days of overstay are accrued in case things go pear-shaped.

Correction, overstay is forgiven when AOS is APPROVED, not just applied for. If AOS is not approved then the overstay counts.

TheLastPetitioner,

It is hard for me to believe that:

a) You would believe the incorrect information, and

b) It would take you days to find the correct answer.

As others have pointed out, people do make mistakes and provide incorrect information at times. Yet, the good thing about VJ is that, as a public forum, there is this check and cross-check process in which incorrect information is often quickly corrected by several other VJ members.

I hope you don't lose any more sleep unecessarily!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I was reading that post and read all the comments posted to the end. It is true for me. I read the posts then go and verify it on the appropriate website and I also read past posts concerning the same topic.

It's interesting how that bothered you for so long. I do hope now you can rest easy.

as embarrasing as it is for me to admit as a geek,we dont have internet yet ( getting it on friday ) and i had to use my husbands phone to use the internet,the battery fried,and it was just,a really long four days

im not sure whether or not youre aware of it,but applying for a visa is different than AOS.if youre not,its alright,youll learn along the way B-)

agreed, there is a lot of scaremongering on this site. I became overtly critical of my own visa application and the speed at which I did it, and convinced myself my interview would be much later than it is.

Everything is case by case anyway.

Much of the "scaremongering" really consists of recommendations to be prudent -- to "hope for the best but prepare for the worst." The worst advice on VJ is along the lines of "you will be fine" or "you can cut corners this way" or "this happened to me, so the same will happen to you."

Everyone's case IS different, but we can glean certain general principles to guide our thinking and actions.

Be aware of as much as you can before jumping into anything; read accurately, interpret literally, and follow instructions completely; do not trust any U.S. consulate in a third-world country unless EVERY review and recent past experience suggests otherwise; and any untruth or material omission WILL come back to bite you later. Probably 99.44% of the good advice from longer-time VJ members pertains to these matters.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
