co sponsor proving income with bank statements/assets...not taxes

i have a few questions for you:

beings it will be my fiance and his son applying for the visa, will they both be charged the amount of $350?

what medical information needs to be collected for his son? will he need a medical exam, the same as his father?

if, my father (the co-sponsor) is self employed and does not file taxes, but can show more than sufficient proof of income through his bank account and his assets, will this be fine?

Why does he not file taxes? If I'm not mistaken they ask for tax transcripts..not sure how many for k1 visa but they do ask for them and if he is excempt from filing them then he needs proof he has exemption and will need to write an explanation as to why he doesnt file.

I'm usure of you first few questions.

The Co-Sponsor is a USC and does not file Taxes. There are few exceptions to avoid that. Making less than $5000.00 a year is one but still must be disclosed. Even self employment requires taxes to be paid and a tax return.

If the Co-Sponsor has money in the bank and does'nt file returns then thats a scary story. There might be more to this but Your Father should get out of Dodge City before signing any papers making good money and not reporting income.

Each person pays the fee for each visa.

Medical is same for both people regardless of age.

Self employment hopefully produces income. Income is taxable.

Its best to submit tax transcripsts. Those prove income & taxes paid in full.

Make sure the embassy will allow a co sponsor.

Yes they both pay $350. Yes, they both need the medical and YES they will both pay all other fees, including AOS fees (there are reduced fees for children under age 13)

Your father IS required to file income tax returns even if he does not owe tax. He should file his taxes for the last three years as he will need at least one year for the visa and three years for the AOS. If he owes no tax, there is no penalty for filing late. Google "1040-2009" or any other year for the correct forms.

DO NOT show proof of income without showing income tax returns. :wacko:

More bad news.

If he does his belated returns and manages to show no income by deducting everything as expenses or costs and depreciation (and he can) then he cannot be your co-sponsor as he has no income.

If his tax returns show he has income, then he is going to owe a LOT in back taxes and penalties. Self employed MUST pay the self employment tax of 15.35% on every dollar they make, that is just Social Security and medicare, that is not even income tax.

In order to be your sponsor, he needs to show enough income to support himself and your fiance and any other dependents he has...and show that he paid tax on it.

Bottom line...find another co-sponsor and be prepared to pay all the same fees and expenses for the child as you do for your fiance.

The income evaluated for a self employed sponsor is line 22 of their most recent tax return. Without a 2010 tax return that person cannot qualify as a sponsor.

Each pays $350 for the interview. And for medical, your fiance will pay 300 soles and his son 180 soles (if he is under 14). And if his son is under 14 he wont need the X-ray or the blood test, just the physical and vaccines

For not filing or filing false returns you most certainly will, it's call Tax Evasion and that's how they put Al Capone behind bars.

Now if you file but can't pay then no you don't go to jail but they will hit you with stiff penalties and can put a lien on your assets including bank/retirement accounts and real property such as house.

Why would I waste a moment of my time?

The OP is asking about a sponsorship question. Without income tax returns her father will not be accepted as a sponsor as he has no proof of income and no proof he can financially support her fiance.

He could go ahead and file his past due returns, show the income and go with your position and then everything would be OK.
