Will the reaffirmed CR-1 petition pass through NVC again?

Hi,

One quick question for all of you. My wife CR-1 visa was reaffirmed by USCIS about 2 weeks ago.

USCIS is returning the petition to the Department of State for action.

Will the case pass through the NVC again? I am asking because the case was processed by NVC

before and the visa was denied at Guangzhou. This the reaffirmed CR-1 petition.

Or the case will be sent directly to the consulate at Guangzhou by USCIS?

I checked the NVC and there is no record of it yet. Thanks for your information.

Hi,

I heard that there is one simillar case (also reaffirmed case) which was sent back to the consulate directly

from USCIS without passing NVC. It only took him 4 weeks to receive the letter from the consulate after the case

was reaffirmed. Is this possible?

Our case was denied by the consulate for rediculous reasons. All of them are not true. One reason, the consulate

even violated State Department and USCIS regulations. It stated the age difference between my wife and me.

The age difference was well known by the USCIS when it approved the petition. Yet, the VO was so ignorant that she

still used the age difference to deny the visa. Of course, my attorney made quite a big noise in the rebuttal letter.

All I can say is that anything can happen during the interview. It all depends who interviewed your SO and her/his mood at

the time.

The CO made up her mind even before talking to my wife. My wife brought tons of evidence and the CO didn't even want to see them.

She was so rude to my wife. My wife tried to show the VO the evidence and the VO walked away from her.

Well, hope your experience will be better than ours. But one thing to remember. As long as you don't give up, eventually your SO will get

the visa because the truth will come out. The USCIS will examine the case carefully and make the final decision to reaffirm the

petition. Good Luck.

Yes. The reaffirmed petition passes the NVC very quickly since it went through there before.

It's not even in the NVC data base. I called the State Department instead of NVC to find

out that the case was sent to Guangzhou. NVC doesn't have the record at all.

The case was just received by Guangzhou. Second interview should be very soon.

Yes, the beneficiary will be informed for 2nd interview in order to get approved!

Hi,

I saw your interview is also coming soon. Our interview is set at the end of this month (Oct).

The wait for the reaffirmed petition was 2 years after the initial denial.

It takes about a year to go through USCIS then you either get a reaffirm or a NOIR which is Notice Of Intent to Revoke and they will give you either 30 days or 60 days to answer. I do suggest you get a lawyer to do that for you. In the mean time keep getting evidence for your case Skype sending money to your spouse or your spouse to you and it's important that you visit during this time as much as you can.

The question on if reaffirmed cases are returned to NVC depends on the Embassy not NVC. Some Embassies want the case to go through NVC most do not. So most go through the Embassy, it all depends.

On the interview that all depends also some ask you questions again others send you notice of what you have to send passport, new police record, medical and they will either send your passport with the visa in it or you go to your interview and basically do the same.

I wish all of you good luck and please find a good lawyer if you were denied.

Our case was reaffirmed jan 13-2016 it has been returned to state dept.but nvc doesnt have it.i opened the ceac website and it says prossecing site tunis.and under the iv in bold red it says reopened.i clicked it and directed me to fill out the ds260 requested by embassy.so i did. now again it says complete.what do yall think? Also recieved an confermation email that its complete

Our k1case has also been reaffirmed but apparently ours had not previously gone past nvc. Nvc sent it back to uscis before we even got a case number. Now on 2nd it was sent back to nvc and today we received a hard letter.

What was your experience?
