Hello All!

Our application for AP was received by USCIS on July 18. My wife's sister is getting married at the end of September. I called USCIS to see about getting her AP expedited. They told me to make an Info Pass appointment at the local USCIS office. We went to the appointment and the lady said she can't help me. She advised me to call USCIS after our Biometric appointment and request her AP to be expedited. We called immediately after the appointment and was told her circumstance wouldn't qualify for an expedited AP. Ugh.

My question is this:

Her parents live right across the border. Can I drive her to her hometown and she go to the wedding? Then when her AP comes through I drive back across the border and give it to her. I understand if we were to fly into Mexico that would be a red flag to immigration. I know by her leaving the country she forfeits the AOS. However, when you drive into Mexico you don't go through any immigration on the US side at all. I welcome your suggestions. Thanks!

If her card is NOT granted then you are screwed.

If her card is granted and has a date on it AFTER she already left she is screwed because they will have on record that she left the US before she had her AP and they may choose to not let her in as she left without the correct documents.

Leaving without AP/GC is grounds for abandonment and cancelation of AOS application.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

There is a point that she does goes thru US immigration, it will be when she comes back thru. If the card has an issued date after she has left the US, then you and her will be screwed.

It's your life and your risk.
