Timeline

Hi Everyone,

I'm about to file the change of status information for my husband (!), who entered on a K-1 Visa. It's a huge amount of money, some of the USCIS forms don't work, so I've had to piece this all together, and i wondered if any of you who have done this can just read this and let me know if I'm missing somethign or on the right track!

He entered on 5/6/11 and we weren't married until July 25. The I-94 expired on Aug 3, and he's been "out of status" since then.

So. I've filled out the I485, and have all the necessary go-withs.

I've filled out the G325A form (Just for him... I don't need to do me, this time, right?)

I've filled out the I864 Avidavit

I've filled out a I765 Employment thing.

I have photos and the fee, which I believe is just the $980 plus the $85 Biometrics. (i read that if you file your employment form with the 485 that you don't have to pay the additional fee)

I understand that:

- They'll eventually call or email or email to set up his appointment to go in and get fingerprinted (the biometrics)

- I can, any time after receiving the NOA, apply for advance parole. (see below)

- Then, they'll someday call for an interview, at which we both must be present with lots of love letters and toothbrush anecdotes, yes?

Questions:

- To apply for Advance Parole, I have to have specific plans, right? I can't just apply for it in case we decide to go somewhere?

- Here's the tricky bit. We waited too long to get him a social security number. I went to the office in July and they said the I94 had to be valid a further 30 days. This forum has said 15 days in places, and the SSA website said nothing. So, at what point will we be able to apply for this again? Must he actually have the green card?

I think that's all. Looking forward to getting this step done with!

7/30/10 - 129F petition Sent to VSC

8/4/10 - NOA 1

10/3/10 - Touched

1/24/11 - Called VSC. Useless

2/1/11 - NOA 2 APPROVED TXT/Email notification

5/4/11 - Interview in Dakar

5/7/11 - Entry into USA @IAD

9/17/11 - AOS, EAD and AP mailed to USCIS

9/28/11 - NOA 1 rec'd for all three

10/18/11 - biometrics (missed due to illness)

12/5/11 - biometrics

12/23/11 - NOA 2- I485 moved to CSC

12/23/11 - EAD approved

1/13/12 - EAD rec'd - wrong DOB

To answer your questions, you will not get calls or emails... you will get letters in the mail. You will get your NOA, and then yes, a letter for a biometrics appointment. Sometime after that the EAD/AP will be approved, and then you will get an interview letter with an appointment. Sometimes the interview letter will come before the EAD/AP. There is also a chance your file will get transferred to CSC for "faster processing" which usually means the interview is waived and the GC approval will come automatically.

You do not need specific plans for the AP. You can put "unknown" for the dates. AP is routinely approved for a pending AOS. He can get a SSN when he gets his EAD. Good luck.
