Also, is it possible to adjust my status to F-1 without going back to my home country even if my visa has expired already?

Because I really wanna study here in the US.

And it is very unlikely you'll be issued another non-immigrant visa after overstaying the previous one.. If I were you, I'd leave the US before you hit the 180 day mark and incur a ban to the US. The longer you stay here out of status, the harder it will be for you to get another visa to come here or to stay here - even a tourist visa.

Hi!

Just a quick question about the J-1 2-yr HRR waiver.

My J-1 visa has expired last June 01, 2011 and I just wanna ask if it's possible to waive it even if I am overstaying?

You have created a mess for yourself.

First, you are currently out of status. You are accumulating days of unlawful presence that could result in a ban from the US. In addition, you are at risk for arrest and deportation.

Second, the 2 years HRR will prevent you from changing your status in the US. Even marriage to a US citizen is not going to help. When you accepted the J-1 visa, you agreed to return to the Philippines for 2 years afterwards because the Philippines government paid for some part of your J-1. To qualify for a waiver of the 2 years HRR, you would need the Philippines government to send in a "no objection" to your waiver; or a compelling reason for the US government to grant it to you. Wanting to be an international student is not a compelling reason. You will need the "no objection" from the Philippines government to overcome the 2 years HRR. You cannot get a student visa without dealing with the HRR issue.

You need to consider what is in your long term best interests. Being an illegal overstay is not a good option. Even marriage to a US citizen is not going to help because of the HRR requirement.

You must resolve the HRR first.

You do not need to resolve the HRR first before getting a F-1 visa. I've been on a F-1 visa for 4 years already. Got it immediately after my J-1 visa with HRR expired.

Jan 9th, 2015: I-130 NOA1 (Nebraska Service Center)

May 20th, 2015: NOA2- I-130 approved email notification

May 27th, 2015: I-130 forwarded to DOS visa center email notiffication
