Hello,

I would need help with some answers on forms I-130 and I-765. I just finished my OPT on 8/16/11, and I'm almost ready to send forms for AOS, but wanted to make sure we did everything right..

A question C-14 on I-130 about what date authorized stay expires or will expire on I-94 or I-95, but my I-94 doesn't say anything about when my authorized stay will expire. I entered the US with F-1 visa. Should I just state the date when my OPT expired or leave it blank?

One more question is about the first one (I am applying for..) on I-765. I already did my OPT on F-1, and should I say I am applying for "renewal of my permission.." or "permission to accept employment"? I'm a little confused that renewal is under the same category.

1. D/S for duration of status

2. "Permission to accept" NOT renewal. It is a new category and therefore a new application. The is a place to mention your OPT EAD elsewhere on the form.

One more question,..In the I-765 instruction, it says no fee for renewal EAD on C(9)(Adjustment applicant) category. Still there is no fee for filing I-765? I thought no fees for I-765 and I-131 when we submit them with I-485. Thank you a lot for your help in advance.

You are NOT a renewal EAD. Please read my above post. You are a NEW EAD with code C9, which is still no fees. NOT a renewal.

I-485 is essentially the AOS form - so you are supposed to be filing that along with the other documents. I-485 is the form you use to apply for permanent residence.

And yes, I-765 and I-131 are free when filed with the I-485.

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011
