Back in 2007 I broke off my engagement just weeks prior to her going for her interview. Iknew something was not right so I broke it off. I contacted the Visa processing center and they told me "it was too close to her interview and that she just needed to not go" Well she went as I received an email she was in the states. I callled ICE and they said she was legal to stay here for 90 days and if I knew she was still here after 90 days I could contact them. Well I never heard anything more from her so I assumed she went back to the Philippines. About 18 months later I heard through the grapevine she was living in another states and was pregnant by a an american she had met in the Philippines after I left (now you know why hunches are good when something does not smell right)....

My question is as I am "thinking" of doing this again with a woman from Manila, Am I at risk to be turned down and am I wasting my time and money in filing? Good news is we are 2 years away as my girlfriend has a 14 year old that she will not leave until she is in College.

Makes no sense. Your timeline indicates a previous approval. 2008

The beneficiary could not be in the States on a K-1 if not married to the ORIGINAL Petitioner.

Thats a start. There is a paperwork trail here somehow and seems to be fraud or stretching the truth. There the same thing. Not saying you did anything wrong but my Kodak picture of what you wrote seems obscure.

Your new Petition for another should not interfere but some questions will come up about how you ex-fiancee entered the states.

It would be easy to find out the details. ICE. but they won't tell you anything.

Just makes no sense to me.

Your Ex-Fiancee got here somehow . I don't know how posible when you never married within 90 days if you are the Petitioner.

Another posibilty for her admission to the States is : Your Petition is over 2 years old. What proof do you have she went to an interview using your name and not a new Petitioner. Questions. ?

Actually I can see how this could happen. Being that it was so close to the interview I would assume the OP sent all info for the interview. So she would have had the I-134. The new guy could have paid 4 her ticket and she never went to the OP's town.

Now if this is how it all went down, she could have received the visa & be staying illegally. There is no way for us to know or judge. If the OP has some proof that she is in the US on the petition he filed for, then he has a legitimate case for ICE, BUT the other guy could have petitioned 4 her 2.

The only thing that I can think is if the OP had the MNL case number then they would be able to check if she was issued a visa under that case.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Thanks everyone. My timeline may be off some as this was a few years back. I had hired an Attorney to handle the K1 ( i do not recommend this route knowing what I know now). We started in July 2007, She failed her medical in February 2008, did a sputum (spelling??) test for a few weeks and then passed.. We broke it off during her sputum testing.... I then contacted Visa Processing the next week as I was busy with work (about 4 business days lapsed if memory serves me correct) then this is when I was finally told it was too late to contact Manila and I was told to inform her not to go to interview which made no sense to me.. NExt thing I know she was in Reno...... I never sent her the documents that came to me from my county health as she needed to check in with them due to her TB or possible TB. She wanted her documents but I did not send to her. I then heard when I returned about 14-18 months later to Philippines for vacation.. I was told then she was with a man she knew at same time as me and she was pregnant living in Florida..... I know it sounds like a Soap Opera but it is the truth as I know it. COuld be why she changed during the process but who knows.

As ICE told me even if I did not break off engagement and she came here. And before 90 days I decided not to marry and she did not return then it was her issue being illegal and not mine. I just don't want any issues in the event I do this again in the future.
