Hi,

I am filling out the I-130 for my husband. (I am the US citizen and he is Canadian.)

I have it mostly filled out but am stuck on Question #22.

I am in Texas getting all settled in, staying at my dad's house. Hubby is up in Canada while we go through his immigration.

The question says:

Complete the information below if your relative is in the United States and will apply for adjustment of status.

Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: (fill in city and state.)

If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in: (fill in city and country.)

I am not exactly sure what to fill in here. Do I list somewhere in Texas? Or since we were told he has to stay in Canada until all his immigration is complete do I fill out some location in Canada?

You haven't given enough info to be precise with my answer, however, if you are seeking an IR-1 / CR-1 visa, he will not adjust status here, so you will use Montreal as the consular post in Canada

You would list the Montreal US embassy because he would be having his interview at the Montreal US embassy. He is not currently living in the USA and is not currently applying for AOS.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You would list the Montreal US embassy because he would be having his interview at the Montreal US embassy. He is not currently living in the USA and is not currently applying for AOS.
