Yes, it's possible they overlooked it. But you're sure he entered the correct amount for line 25? If he filed a 1040, he put the total income or if he filed a 1040EZ he put the gross income? Sometimes, it's not just the sum on the W2s, depending on your job. It fluctuates a bit. I know my husband's income on the IRS transcripts were different than just the sum of his W2s, especially when he was a student.

Anyways, if he did put the correct amount, you can try requesting for a supervisor and asking them if they can review it again.

Hi Saylin!thanks for the response. :)

I don't know anything re 1040. If my memory serves me right, my hubby passed an I-864 form, IRS and W2s (year 2010). We just followed a sample AOS cover letter I found here in VJ. My hubby, unfortunately, moved to another city, making him unemployed as of the moment (in a very crucial time wherein we're goin to pass an AOS form  ) - so no employment letter. So, AOS line 25 = sum of two W2s (year 2010) = IRS (2010). Anyways, we opt having a joint sponsor (coz we know hubby wont be able to meet the minimum requirements needed to support me, the intending immigrant, based on the documents we've submitted). Our joint sponsor submitted an I-864 form, IRS and W2(year 2010), his employment letter and a copy of his US passport.

Hubby's AOS line 25 = $5,000 plus (household size 2) me & hubby

Joint sponsor's AOS line 25 = $ 35,000 plus (household size 2) me & joint sponsor

You think that would be enough?

We talked to an operator and clarified things with him. He admitted that they're overlooked our file. When we asked if we still have to pass another I-864 form just like what the checklist cover letter said, he told us NOT to and just wait 10-15business days coz he'll ask his supervisor to review our case.

Since October 3, we haven't heard any news form them (both in our AOS & IV packets). Every time we inquire to NVC, askin if there's any problem, they're just telling us to wait for 20business days.

Our AOS & IV packets arrived at NVC September 26. I've seen people here in VJ obtaining results from their AOS & IV packets very quickly (5working days). I don't know what's wrong and what's taking them so long to review our papers. I think I'm bein paranoid.

Apology for the very long posting :(

I really hope so! I'm worried that is gonna take longer than just sending in a new birth certificate though.... but is it too late to do that now, since it's already sent on for review? Don't want to confuse them by sending another one in :)

This is such a bummer, was hoping for a speedy case closed. But I guess you never know what the NVC will throw at you :)

Any ideas on how long should we wait before we call them and ask about the review?

Thanks for all your replies Saylin! You're so helpful!

You should be calling every single day during this NVC process. This will be how you find out stuff ASAP. Don't think you ever should wait a few days before calling cause it's on a review or that you feel like you're calling too much. You know NVC's phone number, so use it to your advantage. Now, don't be calling like 10 times a day, that's too much. But once a day is perfect to keep up on things.

The 1040 is the name of the tax form to file taxes every year in the US.

And it might have been okay by just adding up the two W2s, but if any money gets taken our or put in, then that number won't be correct for the I-864. That's why I asked if he filed a 1040, did he put the total income or if he filed a 1040EZ did he put the adjusted gross income? You have to make sure you took the correct amount from the IRS transcripts otherwise your RFE is real.

And yes, with the co-sponsor, it's enough. The poverty line for 2 people is about $20k, and that's well over what you have.

Although some people have gotten reviewed in just a few days, remember, you got an RFE, so it's going to take an additional few days to go over it again. Just keep calling NVC every single day and inquiring about your case. You'll hear something soon.

This is the ####### that I got (my wife) from the NVC, when we've asked to invoice IV payment:

"Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC).

This petition is now eligible for further processing. The petitioner, principal applicant, and/or attorney of record will receive an instruction package regarding further processing of this petition".

Well done, the NVC ! And no IV payment invoiced yet.

It sounds like people from the NVC can't read what's in the request.

At least 2 good news for today:

1. I've changed front brakes and rotors on my car :D .

2. My wife was OK'd into the USA (via Detroit). So she is just 2 hours from Chicago :P. Which is far better than the NVC .

Wow that is some good news - especially on the NVC's holiday!! So happy for you, that you get to see your wife  .

I keep dreaming of taking a quick weekend getaway to Paris - but man is that a pretty expensive weekend.

It'll be good news for me if my boss finally decides to pay me today (been back from France for 2 months now) it's kind of hurting my bank account and my sanity. I've been all alone at work since 8am and finished everything I had to do already. I am waiting for him to come to work already!!!!!!!

Thank you so much Saylin for the tips! ^_^

I talked to my hubby and tried to clarify things with him (so that I'll be knowledgeable to 1040 forms and stuffs). Unfortunately, when I brought up the 1040 topic (thanks again Saylin), we found out that the RFE NVC sent us was a REAL one

I'm sorry if I'm creating confusion to everybody. I sincerely apologize :( Please let me correct my entries and information in my previous posts

Hubby had 3 w2s for year 2010 (not two). It is now clear that one w2 was NOT included in the earlier packet :cry2: Hubby also put the wrong amount in our line 25 AOS form (he copied what our joint sponsor did, the amount of joint sponsor w2 is the same amount declared in the joint sponsor's AOS line 25). So, after calling NVC and tryin to decode things and stuffs, here's what we did/have concluded:

*1040 line 7 = sum of 3 w2s year 2010

*1040 line 38, 1040A line 22, 1040EZ line 4 = AOS line 25 (adjusted gross income)

*1040 line 22 = AOS line 23, 24a, 24c

The operator told us to pass a new, completed and CORRECTED I-864 from my hubby with a copy of his 3 w2s (since we've already included his IRS and original pay stubs on the first packet)-together with the checklist cover letter. Hopefully NVC will receive our packet next week and eventually our case completed :)

I just wanna make sure Saylin, is it okay if the following does not posses the same amount to that of each other?

*1040 line 7 = sum of 3 w2s year 2010 = $9491

I can't say, since I've never filled out a 1040 in my life and don't have one in front of me to know if those numbers correspond to those lines on the I-864.

Finally got my IV invoiced ! Apparently it was done after midnight, because there was nothing yet yesterday.

I've just seen it this morning.

Allegra, your trick works ! So, other people, who stuck with that payment, might try it also.

P.S. No email though to me, as petitioner, about further instructions on visa processing.
