How do i file for my husband in Nigeria?

I need help ASAP! I am a U.S citizen by birth and i recently got married to my husband who lives in Nigeria.

1. do i need a laywer to file or can i do it by myself?

2. What forms do i need to fill out in order to get him a visa?

As far as if you need an attorney or not, the final decision is yours. It would depend on if your situation is straight forward (i.e., no criminal history, deportations, etc.), also depends on how comfortable and how much time you are willing spend to do it yourself. Many people here on VJ (including myself) have filed on our own, with the help of VJ members, the guides, and researching.

Timeline

Nigeria ( Lagos ) is one of the roughest consulates to get a visa from. There are red flags that count heavily against a couple. If the woman is white, if she is older ( especially more than 10 yeas ) if she has been previously divorced, if you married on the first visit and if that visit was less than 2 weeks, if you are a different religion that your husband. The more things you have in the above list the harder you will have to wrok at putting a good package together. Not that a lawyer will do a better job , it is just they will be more apt to say your relationship isn't valid.

This will not be over quickly. You will not enjoy this.

you can do it yourself,if you never have any problems in the past with immigration,file the 1-130 application fee 420.00 you need two G-325A one for you one for her, you need a passport style 2x2 photo one for you one for her put your name in pencil on the back of the photo, put the photo in a small plastic bag clip it to the g-325, you need g-1145 to notify you of e.mail.you need your us citizen copy of your passport, or a copy of your birthcertificate,a copy of your marriage certificate, if any divorces send copies, you need evidence of your marrige bonafide,wedding pictures,letter from friends,boarding pass trips, banking jointly, credit cards,e.mails,read the guides do research, and more research, look at the example forms to get an idea how to file them on this page immigration guides, good luck

I dont live with him right now and we dont have any joint accounts or any of the other stuff they stated as requirements for marriage bonafide. What else can i substitute for that?

They expect married couples to show they co mingle things. That you have added him to your insuurance, that you have joint accounts, that you have done vacations together, If you don't have these things they are not inclined to approve a visa for him. If you just got married then you need to create these things before filing.

This will not be over quickly. You will not enjoy this.

Welcome To Vj If I were you I would go through the list and get the things you do have and go from there....Good luck no need to be nervous or scared just be detailed and pay close attention to details along the way..... :thumbs:

First Congratulations on getting your husband to the USA. I am happy you two are united. I do have a question, did he wait to file the K-3 visa in Nigeria until all your forms were approved here?

I also married in Nigeria and are waiting for the I-129F and I-130 forms to be approved. Any help would be grately appreciated.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
