My fiance interview was today. She failed. They said that I was still living with my ex-wife when I went over to ask my fiance to get engaged. and that I'm still tied to my ex-wife. Both accusation are not true. How would they know that? and why would they say that? what can i do?

Maybe your ex-wife told them to mess things up for you. Are you guys on speakin terms? What exactly did they say?

My fiance interview was today. She failed. They said that I was still living with my ex-wife when I went over to ask my fiance to get engaged. and that I'm still tied to my ex-wife. Both accusation are not true. How would they know that? and why would they say that? what can i do?

What part of the evidence presented would give the CO that idea? What questions were asked of your fiancee regarding your ex wife? That is the likely source of the CO's information.

For most cases the consulate officer got this information byasking the question when you and your finacee started the relationship andcross check the divorce decree date. A friend of mine was on the same problemand the petition was sent back to the USCIS. After a long waiting time the previouspetition expired and filed another one. Now he is waiting for the approval ofhis petition from USCIS. My advice islet your Senators involved and if you knows where your ex is living, you canprovide that information to the office.

I'm not sure why the consular made that accusation. Its no true. I don't even know what prompt the consular to even ask that question. My fiance answered everything correctly. All of my papers were in order. Everything was the truth. I hid nothing... I am reaally confused. Cant even trype right.

The say they will send me the paper explaining the reject. How long will that take?

I will contact my senator.

What if I filed again, but as married. We are married in her custom, but the consular would have no way of knowing that. Do you think this will work?

You'd need to get legally married before filing for a CR-1 spousal visa. But first I would find out more about the denial.

Are you saying there is truly nothing tieing you to the ex? No joint car payments or bills, joint mortgage or anything? Can you prove you lived in a different home from your ex when you met/ got engaged to your fiancee? Were you divorced at that time (not strictly necessary, but they must be basing their accusations on something).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

K1 visa was denied after interview. CO said that I was still living with my ex-wife. (TOTALTY not true). We have been divorce since 2009. Don't know why CO would say that. CO only ask my fiance simple basic questions. my name, place of residents etc....

Can I go back and legally get married and then file a CR-1 or i-130. Will there be any "red flag" from the K1?

btw. I'm writing the senator about this.

Getting married probably wont just " fix " it, You will have to find out why they said this and correct it before getting married.

You need to post the full question not parts of it. You have to over come the fact they think your living with your ex-wife. You wont be able to fix it by just going and getting married and filing the CR-1. You need to find out why they think you live with your ex-wife and why they think your relationship isn't real.

I'm curious about this too... just got an RFE but I don't have the letter yet, and am wondering if it could be related to recent divorce. What else would they check other than that I have included the original divorce decree? Do they check post office records? My ex wife disappeared to other countries with no forwarding address, so the post office still thinks she lives here. I wonder if that would do it?
